Preliminary Plat request for the U.S. Forest service

BACKGROUND: The Kalispell City Planning Board met on September r , 2006 and
held a. public hearing to consider a request by Goldberg Properties, Inc. on behalf of
the U.S. Forest service for preliminaxy plat approval to lease a 5.35 acre parcel from.
the Department of Natural Resources and Conservation n order to construct aanew
facility for the U.S. Forest Service to serve the greater Flathead Valley area. The
proposed lease site can be generally described as lying in the NET 1/4 of the NW 1/4 of
Section 3 , Tovmshl 2 North , Rage 22 West M1 Flathead Count, Montana. The
area of the lease site is zoned R-5 UD (Residential -Professional ffice Planned Unit
Development) .
The planning Board held a. public hearing on the proposed subdivision at its
September 1 th meeting. Staff provided a Brief presentation of the proposed
subdivision and recommended the Planning Board consider amending 2 conditions.
This included amending condition #2 to state that the access road, instead. of "serving"
staff suggested using "abutting the subdivision shad. be designed and construction in
accordance with the adopted Design and Construction Standards for the city of
Kalispell, Staff also suggested amending condition #6 to state that 40 feet of
additional Rom' from the center line of Stillwater Road shall e dedicated along the
road and shall be shown on the face of the final lease site map. With. the 2 amended
conditions in place staff recommended approval of the preliminary plat subject to 1.1
conditions in the staff report. Mike Fraser of TD&, and Grant Nelson of Goldberg
Properties, Inc. spoke in favor of the project. Steve porch from the Montana
Department of Natural Resources and Conservation also spoke in favor of the project.
After the public hea *ng the board discussed the proposal and a notion was made
which passed unanimously to recommend approval of the preliminary plat to the
Kalispell City Council subject to the 11 conditions as amended above.
RECOMMENDATION: motion to approve the preliminary plat with the 1.1
conditions attached in Exhibit A would be in order-.
FISCAL EFFECTS: Positive impacts once fly developed,

WHEREAS, Goldberg Properties, Inc, on behalf of the U.S. Forest Service, the lessor of the certain real

WHEREAS, S, the Kalispell City Planning Board and Zoning Commission held a public hearing o

At the Co cil's October 2ndmeeting you will be considering a request for prehminary
plat approval from the U.S. Forest Service to lease a. 5.35 acre area located on the
Montana Department of Natural Resources and Conservation land � Section 36. The
proposed lease site is south of Glacier High School and adjacent to Stillwater Road.
The Kalispell. Public Works Department artment anticipates the reed to upgrade Stillwater
Road in the future due to the potential for future residential and commercial
development t in the area. The Planning Board recommended approval of the lease site
with condition addressing land dedication along Stillwater Road for future wldenm w
However, , the staff report did not include a condition r e .=g the property owners
valve their right to protest an SID for the future upgrade of Stillwater Road to City
standarkds. This was an oversight and the Planning Department is recommending the
Council consider adding the following condition to the preliminaryplat-.
"'A rote shall be placed on the final plat stating the owner waivers the right to protest
an SID for the upgrade of Stillwater Road to City standards."

Conrad oriented the board on the location of the proposed
USFS headquarters.
Conrad said that the high school came in for a preliminary
plait for a. lease site and one of the conditions was to
construct 300 feet of the no name roadway from Stillwater
Road and this road would then serve the high school parking
lot. This developer would be required to extend that roadway
an additional 120 feet to the east, which is the eastem
bounder lire of the lease site.

planm'ng board . amend Condition #6 which speaks to the
R W along Stillwater Road. Due to future development in the
area Stillwater Road will most likely increase to some type of
collector capacity therefore there is a need for additional
R W, The amendment t to Condition #6 would state that 40
feet of additional R W from the center line of Stillwater Road
shall be dedicated along the road and shall be shown on the
face of the final lease site map. Conrad added that the
developers are fine with this amendment.

pedestrian bicycle path. R W or just the future expansion of
the road. Conrad sa:.d the 40 feet would accommodate the
road expansion and a boulevard strip and a. future sidewalk
or bike trail.

Reserve connector. Conrad said that it does.
AP . CAN' /AGENCY Mike Fraser, Thomas, Dean & Hoskins said he was speaking
on behalf of the applicant. He noted that the owner is DNRC
and the applicant is Goldberg Properties who are negotiating
a. lease for the property and will eventually build a building
and lease it to the Forest Service. This subdivision is
apprommately a 5.5 acre parcel. R W will be dedicated for no
name road. The staff report and conditions speak for
themselves. The high school will be required to build the first
Soo feet of no name road and the apphcarrt will finish the
other 120 feet. The road will be finished with curb, gutter
and sidewalks to city standards. Along Stillwater Road there
is a 60 foot declared R/W and to clarify its status they will
dedicate 40 feet - the existing 30 feet from the center line
east plus an additional 10 feet and as they move through the
project and comply with Kalispell standards they will also
build an 8 foot bike path along that R W so there eventually
e a hike path from Three Mile Drive north all the way to
West Reserve and to serve the high school.
Grant Nelson with Goldberg Properties noted he is available
for questions. Nelson said that they are excited about the
project and hopefully they will open a year from now. The
are trying to move quickly for the Forest Service and are
trying to get them moved into the facility which they hope
will be an asset to the community.

This application is reviewed as a major subdivision in accordance with State statutory
review criteria and the Kalispell. City Subdivision Regulations. The following findings are
made:
A. Effects on Health and Safety:
This s , division would be in the service area of the Ka..s ell Fire Department.
The property can be considered to be at ioxv risk of fire because the subdivision
would be eon tr .cted in accordance with the International Fire Code and the access
road would meet city standards. The property does not have steep slopes or woody
fuels. Hydrants will be required to be placed in compliance with the requirements of
the International Fire Code and approved by the fire marshal. Also, the city's new
fire station is located approximately 2 miles driving distance southeast of the
proposed lease site providing for efficient emergency services response tires.
Flooding: According to the Flood Insurance Rate Map panel # 1805D, gore are no
areas subject to flooding or mapped within the designated 100-year flood lain.
Access. All access to this lease site will be from are access roadway runruffig west to
east and constructed off of Stillwater Road within an existing 0-Foot road right-of-
way, In order to provide legal and physical access to the lease site the access
roadway will be required to be constructed to current City of Ka i.s ell road design

Effects on Wildlife and Wildlife Habitat:
The site is not rapped within any big game meter range and does not provide
significant habitat to wildlife. The property has been intensely farmed in small
grains for several. decades. It contains no trees, shelter, forage or riparian areas.

C. Effects on the Natural Environment:
Surface and Ground water: This subdivision will be served by public water and
sewer thereby minimizing any potential impacts to the groundwater. No surface
grater is in close enough proximity to the site to create concerns With regard to this
development. There is no floodplain in the area or on the property.
Drainage There is no municipal storm water system serving this site. All storm
water will have to be managed and r. amtained on site via an engineered collection
and dis osai plan.
D, Effects n Local Services:
Water and Serer; Muir ci al water and sewer limes are located north of the proposed
lease site at the intersection of Stillwater Road and west Reserve Drive. The
developer will be required to extend the water and sewer mw*n lines within the
Stillwater Road right-of-way to the furthest extent of the proposed lease site
boundary.
Storm waiter mana err ent: There is no municipal al storm grater system serving this
site. All storm grater will have to be managed and maintained ned on site via are
engineered collection and disposal plan..
Roads: All access will be off of an access roadway connecting the lease site to
Stillwater Road. The developer is responsible for constructing the access roadway to
city standards from Stillwater Road east to the furthest extent of the lease site. The
access roadway will be constructed with curb, gutter, boulevard, sidewalks and
street trees on both sides.
Stillwater road is currently a paved roadway approximately 24 feet wide within a
0--foot easement. The KalispeR Groff Policy 2020, Chapter 10 Transportation,
states that St 1 va.ter Road is an emsting rural minor arterial which in the Kalispell
Transportation ortation Plan recommends the road be widened to include paved. shoulders,
improved recovery zone, and left -turn lanes at major xr�tersecting streets or drives.
Due to the current mature of the roadway and the reed for future widening and
improvements to Stillwater road., the Public Works Department is recommendmg an
additional 10-feet of road right-of-way be dedicated along g the lease site frontage
along Stillwater Road. When development occurs along the west side of Stillwater
Road the developer here will also he re fined to dedicate 0-feet of additional right-
of-way. This will insure that Stillwater Road can be upgraded to accommodate
increased traffic in the area.
The preliminary lease site plan submitted writ . the application indicates access to
the site from the proposed access road, located along the northem end of the lease
site, and an access driveway off of Stillwater Road. Ater revie x g the subdivision,
the Public Works s Department is recommending that no access driveways be allowed
from the lease site directly onto Stillwater Road. Policy 6, Chapter 10 of the
Kahs ell Groff Policy states, "Provide access to Mdividua.l lots by moray of local
streets to the maximum extent feasible and avoid granting individual access on to

collectors and arteri a s . Stillwater Road will be improved to function as an arterial
in the future and the Public Works Department recommendation would hel.p to limit
the number of access points on the roadway which in turn will provide for better
traffic flow in the future.
Pedestrian access: Sidewalks ill be provided on both sides of the access roach to
provide pedestrian access to surrounding commercial businesses east of the site
once they are developed..
Schools: This subdivision is within the boundaries of School District 5. Because of
its commercial nature it viH not generate school children. 'faxes generated from the
project will bereft the school district and proceeds from the leases collected by the
DNRC will benefit the School Trust Fund.

area are adequate to accommodate any necessary hydrants. Street and arking lot
design will also be reviewed at the time the developer submits a building permit.
Fire protection is provided by the Kahs el.l Fire Station No. 62, loca.ted along Reserve
Loop, approximately 2 miles .riving distance southeast of the proposed lease site.
Refuse Disposal : The subdivision will be served by the City of Kakis ell for solid
waste disposal. Adequate space at the County landfill is available for the sohd waste
which will be generated by the subdivision.
Medical Services: Kalispell Regional Medical Center is approximately three r .i.les

intended use of the lease site are in accordance with the existing zoning on the

G. Compliance with Zoning Relations
The zoning for this property is a s eeia y crafted PUD ordinance (Spring Prairie
UD) adopted in December 2001 by the City Council. It is based on the R-5
Residential/ Professional office zoning district. The proposed size of the lease lot
and the intended use comply with the adopted to Sprig Prairie PUD. Conditions of
approval for the preli.r nary plat will require subsequent development on the
proposed lease site to comply with all of the provisions of the Spring Prairie PUD as
