Resolution 5794 - Amends PW 2015 Design & Construction StandardsRESOLUTION NO.5794 A RESOLUTION TO AMEND THE 2015 STANDARDS FOR DESIGN AND CONSTRUCTION FOR THE CITY OF KALISPELL, MONTANA, AND SETTING AN EFFECTIVE DATE. WHEREAS, on April 6, 2015, the City of Kalispell adopted Resolution No. 5707, the "2015 Standards for Design and Construction" for the City of Kalispell, Montana; and WHEREAS, inadvertently, sections referencing sewer testing requirements and measurement and payment from the Montana Public Works Standard Specifications (MPWSS) for sewer main installations were deleted; and WHEREAS, in order to correct the unintentional deletion of required sewer main testing, an amendment to the 2015 City's Standards is required; and WHEREAS, on November 7, 2016, the City of Kalispell adopted Resolution No. 5788, a Resolution of Intent to amend the Standards for Design and Construction; and WHEREAS, on December 5, 2016, the City Council of the City of Kalispell held a public hearing, after due and proper notice, and received no public comment upon the proposed amendment to the Standards for Design and Construction; and WHEREAS, upon consideration of the recommendations made by the city public works professional staff, comments provided by the public and upon review of the proposed amendments, the City Council of the City of Kalispell finds that it is in the best interest of the City to amend the Standards for Design and Construction as set forth in Exhibit "A" attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. The City of Kalispell Standards for Design and Construction shall be and is hereby amended as set forth in Exhibit "A", attached hereto. Exhibit "A" shall be made available to the public upon request at the city offices of Public Works. SECTION 2. This Resolution shall become effective immediately following its passage by the City Council and approval by the Mayor.
