have reviewed the proposed Petition for Initiative regarding the amendment to
the Kalispell Growth Policy 2020. The proposed Initiative measure does meet the
purpose of MCA ;5w 31 and - 5-132, as well as the purpose of MCA. - - ,
and I am satisfied with the form of the Statement of Implication. However, the
proposed Statement of Purpose fails to comply with MCA -5- 3 3) in that it far
exceeds the too word limit for a concise ballot statement. have therefore provided
the following Statement of Purpose:
The purpose of this initiative is amend the Kalispell Growth Policy 2020, said
amendment consisting of ` teat and reap changes to serve as a guide in future
lard use decisions to include approximately 8,22 acres of property located in
the area bounded by the Stillwater .diver as the western boundary, Church and
Birch Grove Drives as the northern boundary, LaSalle to Rose Crossing over to
the Flathead River as the eastern boundary, and Reserve Drive as the southern
boundary, said property to be assigned, upon annexation to the city, land use
designation consistent with said amendment.
The number of the initiative should be Initiative No. 107. 1 believe that you
have within your records the number of registered voters within the City o
Kalispell so that you may apply the appropriate formula to determine the number o

POLICY AMENDMENT AREA HEREIN:
GOAL 1. Fstablish a comprehensive public review process that:

POLICY 1 t The City of Kalispell shall establish Annexation & Land Use Guidelines, in keeping VAth this amendment,
to guide review and consideration of future annexations and land uses proposed in the North 93 Growths Policy
Amendment Area (North 93 GPAA), so as to implement Goal I as well as other goals and policies in this North 93 Groff
Policy Amendment, and to provide the comprehensive review process called for following the adoption of this amendment
and p or to additional annexations in the Forth 93 GPAA,
POLICY 2. The City of Kalispell shall further implement the North 93 Annexation & Land Use Gui elin" Amendment
to the Kalispell Growths Policy 2020 by pufting in piace the procedures or regulations necessary to ensure that conditions of
annexation and future proposed land uses in the North 93 OPAA are consistent with the Kalispell Growth Policy 2020 and
its amendnnents When providing guidance for future land uses including, rt not limited to, all general commorcial uses
and neighborhood commercial uses, mixed use developments, light industrial uses, planned unit dOvelopments, and
neighborhood pleas.
POLICY 3. A wavier process from compliance with adopted Annexation and LanO Use Guidelines,
may be establish for minor residential uses of five lots Qr less that do not include general or neighborhood cornm r i i,
industrial uses, mixed uses, or high density residential uses, and that are contiguous to the city,
POLICY 4. The City of Kalispell shall require disclosures of all current and potential interests in the North 93 Plan area
as part of the annexation process, so as to not allow evasion of the Annexation & Land Use G'uldelines through a series of
multiple developments and annexations.

fiscal analysis for applications that disclose the short- and long -tern financial impacts of the proposed annexation upon the
city both during development and following project rpleti, including an analysis of how the residential and commercial
land uses proposed are needed to meet US Census projected po Ul tion growth and demographics in the area. Uncler

which also seek to maintain the attractive character of the Kalispell area while attracting and creating new good -paying
jobs.
POLICY 2. The city should work to preserve a balanced mix of local, regional, and national -based businesses and
small- and rnedium.-sized businesses that maintain and promote the long -tern econornic health of community as a whole.
POLICY 3. Annexations should not contribute to excessive new'development outside of the Kalispell downtown area
when vacancies and redevelopment potential exist in the downtown area and the developing retail area south of West

Deserve Drive.
GOAL . Create vibrant neighborhoods and mixed -use areas* with balance of housing, employment and
recreational opportunities-
POLICY 1. As part of the AnnexcWion & Lend Use Guidelines compliance process, the city will ensure that each
proposed residential ply provides a mix of housing types integrated throughout proposed future developments that
allows for the project to meet a percentage of tree city's affordable housing need,
POLICY . As part of the Annexation & Land Use Guidelines compliance proQesa, the city will ensure that if a project
is adjacent to property which is already developed, or is being developed or proposed as part of the Annexation and Land
Use Guid eline process, the project gill be designed so that there is connectivity of trails, open spaces and transportation
corridors, the designs of streetscapas and public open space amenities are compatible, and the project wiii result in the
functional and visual appearance of a compaWe project with the adjacent properties:
POLICY 3, As part of the Annexation & Land Use Guidelines compliance process, the city will ensure proviSion of on -
site recreation areas and regional park facilities including also, where possible, recreational facilities that can provide
public access to public water bodies, and fe111ties sufficient to meet the needs of residents and the City, exceeding or at
minimum consistent with levels of service adopted by the city. This shall include providing for a coordinated system of
trails and pedestrian linkages both within end connecting to existing or planned regional or local trail systems outside the
proposed project area.
POLICY It should be permitted, in the Annexation & Land Use Guidelines adopted for the North Kalispell Growth
Policy Amendment Area, for a town -centered core subdistrict to be establishied in the map area identified as Kul-1. As
such KN. 1 would be ide ntifi as a new "Target Development Area" as defined under the Kalispell Growth Policy 2020,
This district would be designed to accommodate the phased development of a nix of residential, Wsiness,
communications, office, government, retail, culture, education, visitor a=mmodations and entertainment. Need for the
proposed uses and the appropriate phasing of these tises must a first established in accordance with Goal
POLICY S. A town -centered core stibol'istrict shall be defined as an intemally located area within a "Target
Development Area" which Is an urban mixed use area In which general Commercial uses do not exceed o f this town -
centered core subdistrict, A limited urban mixed use area shall be defined as an area dominated by a housing paftern that
supports higher density housing around the town -centered core subdistrict with lower densities of housing as distance
from the town -centered core subdistrict is inQreased.
POLICY 6. A town -centered core subdistrict permitted in the map area identified as KNA shall not exceed % of the
N-1 area.
POLICY 7. A town-centero core subdistrict permitted in the map area identified as KID-1 shall be ringed and linked
by various non -mixed use residential configurations covering up to % of the area and integrated open space and
recreational uses covering up to 20% of the area.

Council in the form of a Planned Unit Development so that the impacts of this development can be planned for and, if
accessary, mitigated thrQugh improved design.
POLICY 10. Neighborhood Commercial development 0ould be consistent with the map for the Highway 93 North
GPAA,
POLICY 11. Development of neighborhood commercial uses should follow the establishment of residential uses that
justify a need for nel hborhood commercial.
POLICY 12. Pedestrian and trail systems should be incorporated into bermin, general landscaping, greenbejts, park
areas and setback standards along gateway entrances to enhance or maintain the to nic value of the entrance corridor
from publio facilities, neighborhoods, schools and o m er ial services_
POLICY 13. Qated and wall -surrounded developmentri shall~ not be permitted in the North 93 Growth Policy
Amendment Area. On street parking shall be allowed on subdivision roads.

Policies for Goals 11 and 6.
GOAL 6. Secure appropriately scaled retail, office, light industrial, and mixed uses in a townocentered
pattern that is not highway -oriented or jot a ritripcommercial nature,
POLICY 1. To avoid abandoned buildings and blight on the community and in keeping with other goals and policies in
the growths policy including "in designated `nixed use area, allow for a compatible Mix of office, commercial, light industrial,
residential and Public facilities", structures in the forth 93 Growth Policy Amendment area shall not exceed 60,000 sqtjare
feet in cross floor area and no combination of structures on the same or on confiquous lots or parcels shall exceed 60,000
square feet in gross floor area for a single or commonly controlled retail salesand/or retail services operation.
POMY 2. Application for large-scale retail develQpr ent shall include a renewal plan that will afford maximum
opportunity, for the rehabilitation or redevelopment and maintenance of the structure in the evert of closure or relocation

POLICY 3. Retail development consisting of a single tenant building greeter than 40,000 square feet may offer for
direct sale to t�je public merchandise which is displayed outdoors, but the area cu pi d by outdoor sales shall not exceed

development to assure adequate landscaping and attractive v ii appeal,

by giving priority to redevelopment or hirill as well as business retention efforts and infill inconfives and disincentives to

an i 1p ted during the development phase of the proposed project together with recommended mitigations to ensure that

serve existing residents.

interchange and conversely limit direct sass onto US 93 for at least one mile along areas north and
oum of this facility to avoid congestion points and the need for future traffic signals. The iudiczious use of
right-4n right-otit approaches, frontage roads and good internal development street design will rnitgate ihe
