Background: 2nd Avenue West, from Center Street to 4th Street, is currently a timed parking zone with 2-hour parking, along with portions of streets to the west of this section of 2nd Avenue West. Planning department staff approached the Parking Advisory Board recommending the removal of time restrictions. This area, according to their studies, is under utilized. Planning staff believes this area could be better utilized with downtown employee parking, thus freeing up more parking spaces closer to downtown. The Parking Advisory Board agreed with the recommendations. Fiscal effects: There will be less revenue from parking citations written in this area, with the exact amount unknown. Revenue from 2-hour parking in 2015 was $21,930. There are approximately 70 block faces with 2-hour parking. This area accounts for about 12 block faces. If parking citations were evenly distributed throughout the district, there could be an estimated loss of $3,728. However, this area is less utilized. Alternatives: Keep the current time restrictions. Recommendation: Eliminate the time restrictions on 2nd Avenue West, from Center Street to 4th Street West, and the streets to the west of 2nd Avenue West. -` ROGER NASSET. CHIEF OF POLICE ORDINANCE NO. 1781 AN ORDINANCE AMENDING CHAPTER 17 OF THE KALISPELL MUNICIPAL CODES ENTITLED MOTOR VEHICLES AND TRAFFIC, DECLARING AN EFFECTIVE DATE AND AUTHORIZING THE CITY ATTORNEY TO CODIFY THE SAME. WHEREAS, pursuant to Kalispell Municipal Code Chapter 17, entitled Motor Vehicles and Traffic, the City of Kalispell regulates the use of motor vehicles for the purpose of providing for the safe and orderly use of such vehicles on the city right-of-ways and in city controlled public parking areas; and WHEREAS, it is in the best interests of the City and its residents and visitors that its ordinances which regulate motor vehicles and traffic be reassessed and updated from time to time to ensure that the purposes of the regulation and the interests of the public are being properly served; and WHEREAS, the Kalispell City Council finds that the amendments to KMC Chapter 17 set forth in Exhibit "A", attached hereto, are necessary and proper to align with changes to Montana State law and changes to traffic development and uses within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. The City of Kalispell Municipal Code is hereby amended as set forth in Exhibit "A", attached hereto and incorporated fully herein by this reference. SECTION 2. The City Attorney is hereby authorized and directed to recodify this Ordinance. SECTION 3. This Ordinance shall take effect thirty (30) days after its final passage. Overtime Parking Prohibited: It shall be unlawful and a violation of the provisions of this article for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described. B. Remaining Beyond Prescribed Period: It shall be unlawful and a violation of the provisions of this article for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space. C. Two Hour Parking: It is unlawful and a violation of this article for any person to permit a vehicle to remain parked continuously in any individual parking space for more than two (2) hours between 8:00 a.m. and 6:00 p.m. on any day except Sunday or a legal holiday on the following streets: 1. On Main Street between Center Street and Fifth Street; 2. On First Avenue East between Center Street and Fifth Street East; 3.
