AN ORDINANCE TO AMEND SECTION 7.0.OIO, OFFICIAL ZONING MAP, CITY of
KALISPELL ZONING ORDINANCE, (ORDINANCE C No. , BY ZONING CERTAIN REAL
PROPERTY DESCRIBED AS ASSESSORS TRACTS 41 AND 4C LOCATED IN THE SE 1 of
SECTION 309 TOWNSHIP NORTH, H, RANGE 21 WEST, .M.M., FLATHEAD COUNTY,
MON ' NA PREVIOUSLY ZONED COUNTY - , BUSINESS AND COUNTY R-1, SUBURBAN
R SIEN L%LTO CITY ; (GENERAL COMMERCIAL), IN ACCORDANCE WITH THE
KA ISPELL GROWTH POLICY 2020, AND TO PROVIDE AN EFFECTIVE DATE.
WHEREAS, Eisinger Properties, LLC and Lyle and Joanne Davis, the owners of the property described
above, petitioned the City of Kalispell that the zoning classification attached to the above
described tracts of land be zoned -2, General Commercial,, on approximately 15.4 acres of
lard, and
WHEREAS, the property is located at the northeast corner of the intersection of Higbway 93 and West
Reserve Drive, and
WHEREAS, the Eisiner/Davis petition was the subject of a report compiled by the Kalispell Planning
Department, Staff Report KA-o -, dated April 19, Zoo , in which the Kalispell Planning
Department evaluated the petition and recommended that the property as described above he
zoned B-2, General Commercial, as requested by the petition, and
WHER AS after considering all the evidence submitted on the proposal to zone the property as described
-2, General Commercial, the City Council finds such initial zoning to be consistent with the
Kalispell Growth Policy 2020 and adopts, based upon the cariterion set forth in Section - -
08, M.C..A., and State} Eta~. v. hoard of County C mr lssioners Eta;. 590 P2d 602, the
findings of fact of KPD as set forth in Staff Report No. KA-0-3.
NOW THEREFORE., BE IT ORDAINED Y THE CITY COUNCIL of THE CITY of KALISPELL AS
FOLLOWS:
SECTION 1. Section 27.02.010, of the official Zoning Map of the Kalispell Zoning
Ordinance, (ordinance No. 0) is hereby amended by designating the
property described above as -2, General Commercial, on approximately
15.4 acres of land.
SECTION 11, The balance of Section .02.010, official Zoning Map, City of Kalispell
Zoning ordinance not amended hereby shall remain .in full force and effect.
SECTION HI, This ordinance shall be effective thirty 3 days from and after the date of
its final passage and approval by the Mayor.
