During the public comment section for this line item, Marvin Galtz, representing the Soul of the Valley, LLC made a request for a deviation from City standards to the City Council. Public Works was not in attendance at the meeting, and did not realize the deviation would be requested. As a result of discussion among the members of the Council, the decision was made to have Public Works present the situation to Council during the Work Session on April 11, 2016. Council wanted to know why staff required the developer for this subdivision to downsize existing services at the main, instead of allowing the developer to downsize the service after the curb stop. DISCUSSION: Initially, the development had 8 to 10 unit condominiums proposed for the remaining unbuilt portions of the development. Water and sewer services were sized for the proposed condo units and stubbed outside the roadway. The water services were all sized at 2 inches. Soul of the Valley modified the original development from larger multi -unit structures to multiple two -unit condos. This increased the number of services required, and decreased the size necessary to service the units. City Standards and Montana Department of Environmental Quality requires a single service to each structure. For this reason, several new services were going to be necessary to serve the additional structures. The City of Kalispell requires the water service to be sized the same as the tap in the main and the water meter to match the service size. These requirements have been long standing City policy, follow the recommendations of our meter manufacturer, create equity between customers, and promote better operation and maintenance of the City Utilities. Doug Russell — City Manager RE: Water Service Modifications for the Meadows at Four Mile Page 2 Standard policy requires the existing oversized services to be abandoned at the main and the new smaller services to be tapped at the main and trenched across the roadway. After multiple discussions with the developer's engineer, a compromise was reached to allow the developer to downsize the service at the main rather than installing an additional service saddle and retapping the main. Additionally, the developer could use the existing 2 inch service line as sleeve so that the smaller service line would not be required to be trenched across the street. A new smaller curb stop and meter pit would be required in the boulevard. In 2009, the City received a deviation from the Montana Department of Environmental Quality (MDEQ) to approve Municipal Facility Exclusions (MFEs) beyond the capacity of Grandview Lift Station. In 2015, the City received a deviation from the MDEQ to approve MFEs beyond the capacity of Trunk Line A. Both of these deviations were approved contingent upon triggers requiring the design and construction of a West Side Interceptor. City Council approved of staff s recommendation to hire a consultant for planning and design of the West Side Interceptor. Robert Peccia and Associates (RPA) were selected as the City's consultant for this project. The preferred route assessment was completed by RPA and presented to Council at a Work Session in December of 2014. With the preferred route assessment complete, RPA began work to secure properties and easements for the preferred route, and begin planning and design for the project. MEETING PRESENTATION: Staff will be presenting an update on the WSI project. The presentation will cover the following items: • A brief review of the preferred route assessment, • The WSI bypass casing project, • Land acquisitions to secure the route for the WSI, • Easement and construction permit purchases and negotiations, • Discussion pertaining to an easement negotiation with the Two Mile Tracts HOA, • Modifications to the project, • Updates to the project cost estimates, • Discussion on the timeline for the remaining design and construction of the WSI. Ordinance 1768 was for the creation of a new B-3 Zoning District, and Ordinance 1769 was for the rezoning of the Moose's property to the new B-3 Zone. Throughout the hearing process there were some concerns raised about how the rezoning process within the Core Area would be managed, moving forward. Accordingly, the City Council requested that there be a work session scheduled to discuss the management options, and adopt an appropriate policy. Staff has prepared a DRAFT resolution setting forth the practice for amending existing Kalispell City zoning designations, within the Core Area. In summary the resolution; 1) Encourages property owners within the Core Area to petition for zone change in the land use designation of their property to the B-3 Zone; 2) Planning Department would initiate an outreach program to provide information to all the property owners within the Core Area about the B-3 Zone; and 3) City of Kalispell would waive the zone change application fee for all land owners making such petition for B-3 Zoning within the Core Area. The application fee waiver would be effective for a two year time period from when the resolution is passed. RECOMMENDATION: It is recommended that the Kalispell City Council review the proposed resolution and determine if it is an adequate policy for the implementation of the B-3 Zone within the Core Area. ATTACHMENTS: Draft Resolution Core Area Revitalization and Zoning Map Report compiled: April 6, 2016 Aimee Brunckhorst, Kalispell City Clerk WHEREAS, on December 17, 2012, the City of Kalispell Core area was demarcated and defined by Resolution No. 5601(A) wherein the City's growth policy was amended to specifically consider the land uses within the area affected by the railroad tracks traversing central Kalispell from east to west and which includes approximately 364 acres along the rail corridor within the city limits; and WHEREAS, on February 4, 2013, by Resolution No. 5605, the Kalispell City Council found it to be in the best interests of the City to amend the West Side Urban Renewal Plan to include the Core Area Plan which includes public projects to encourage the removal of blight through a number of public infrastructure improvements and the removal of the railway tracks that bisect the area; and WHEREAS, on March 21, 2016, the City of Kalispell, passed Ordinance No. 1768, amending its zoning code specifically as it relates to the Land Use Zone B-3, creating a B-3 Core Area - Business Zoning District, designed to encourage private investment in dense mixed uses; and WHEREAS, the Kalispell City Council finds that it is in the best interests of the City to adopt a policy that invites property owners within the Core Area to join in a petition for a change in the land use designation for their property to B-3 Core Area - Business Zoning District. 1`111 0 KALISPELL, AS FOLLOWS: SECTION 1. That it is the desire of the Kalispell City Council that property owners within the Core Area should be encouraged to join in a petition for a change in the land use designation for their property to B-3 Core Area - Business Zoning District. SECTION 2. That the City of Kalispell Planning and Zoning Department should initiate an outreach program to provide information to all property owners within the Core Area regarding the general urban renewal core area plan and the benefits that the property owners may derive from a change in the land use designation of their property to B-3 Core Area - Business Zoning District. SECTION 3. That the City of Kalispell shall waive the Zoning Change Application Fee for all land owners who join in such petition for B-3 Zoning within the Core Area. SECTION 4. This resolution shall become effective immediately and shall remain effective for a period of two years from the date below written.
