WHEREAS, The Great Northern Railway Company has offered to
enter into, and has executed, on its behalf, subject to
its acceptance, ratifhation and execution on the part of the
City of,Kalispell, the following contract, to -wit: -
"This Agreement, We and entered,into this U Btdday of
Septenber, A.D. 1909v by and between the Great N rthern
Railway Company, a copporation duly organized and existing
under and by virtue of the laws of the State of Minnesota,
(her inafter called the Rail way Company) the first party,
and the C07 of Xalispd.l, a municipal corporation of the
State.of Eontana, (0reinafter called the City) second party;
VITNESSETBO That the said Railway Company does hereby
give�and grant -unto the said City the rigbti privilege and
authority to�use for the purpoae of 5 public street the fol-
lowing described landa in-theVity of Kalispell* County of
Platbeadl State of Xntanaj�particularly bounded and described
as follows, tewit:-
A strip of land Fifty (50) feet in width, extending from
the west siie of Fourth Avenue East to the east site of Fifth
Avenue West, of said City of Kalispell along the south side
of the right-of-way or statlon grounds of said Railway Company
and immediately adjoining the.platted townsite of said City,
upon the terms, conditions and agreements, subject to the
restrictions and reservations hereinafter set forth, to-wit:-
(1). The adid City 1, to pay thee xpense of removing all
buildings beloneing to the Railva y Company, situate within
the limits of the property hereinbefore described, to a suitable
lWation on the Compan7ls grounds adjacent thereto. The work aCf
such removal is'to be done by the Railwa7 ComTany and thle
actual cost thereof will be paid,by the City to said RaillumqY
Comnanm upon demand.
(2)0 Tye said strip is not to be used in such manner as to
in anyway interfere with the loading and unloading of tearmas
.at the warehouses and freight depot adjoingin said stript-

(Q. 'The said Railway Company reserves the right to lay
Wni maintain and ope rate its railway tracks in, across and
along said strip, and each and every portion thereof, but in
so doing shall conform as nearly as mat be to the grade of
said street, and in the construction, maintenance and operation
of sid tracks the said company shall conform to any reasobable
regulations that may be made by said City.

BE IT RESOLVED BY THE CITY COUNCQ OF THE CITY OP KALITPUL:
That the Northern Idaho and Montana Power Company to re-
quired, and is hereby required, in accordance with the pro-
visions of Ordinance No. 21 heretofore passed to extend its
water mains as follows: -
Beginning at the end of the present water main on
First Avenue East and Eighth Street and extending from thence
south to Ninth Street there to connect with the water main
heretofore laid.
Beginning at the end of the present water main at the
I intersection of Fo"rth Avenue West and Ninth Street and run-
ning thence south along the West side of said Fourth Avenue
West, to Eloventh Street, - a distance of two blocks.
And permission is hereby given the 17"'rther Idaho and
Montana Power Company to use wooden pipe wrapped with wire and
of, the same constr�ction, etc. as by retofore usedin the ex-
tension of mains in the Cit7 of Kalispell.
Be it forther Realved, that the City Cle rk be directed
to serve a copy of this resolution together with an order re-
quiring the extension of said mains as abo e set forth upon
the Northern Idaho and Montana POwer Company.
