SUBJECT: KCU-15-06—Conditional Use Permit (CUP) for Healthcare "Assist" Facility
MEETING DATE: February 1, 2016
BACKGROUND: A request from Marise Johnson, for a conditional use permit for a 24-hour
healthcare facility, within the H-1 (Healthcare) Zoning District. The facility will operate as an
"Assist" facility, providing care for patients that do not need to be in the hospital but are not ready to
go home. 24-hour care facilities are permitted within the H-1 Zone provided a CUP is obtained per
Section 27.11.030 of the Kalispell Zoning Ordinance. The project involves renovating the interior of
the building to accommodate ten (l 0) new rooms for patients. No exterior renovations are proposed.
The property is located at 1280 Burns Way. The property can be described as Lots I l & 12 of
Highland Park Professional, located in the SW4 of Section 6, Township 28N, Range 21 W, P.M.M.,
Flathead County, Montana.
The Kalispell Planning Board held a duly noticed public hearing January 12, 2016, to consider the
application request. Staff presented staff report KCU-15-06 providing details of the proposal and
evaluation. Staff reported that the proposed CUP was compatible with the zoning, the growth policy,
and the applicant has met the burden of proof requirements. Staff recommended that the Planning
Board adopt the staff report as findings of fact and recommend to the City Council that the CUP be
approved, subject to four (4) conditions.
There was no public comment regarding the application. There being no public testimony, the public
hearing was closed and a motion was presented to adopt staff report KCU-15-06 as findings of fact,
and recommend to the Kalispell City Council that the CUP be approved, subject to conditions. Board
discussion concluded that the CUP was appropriate, and the motion passed unanimously on roll call
vote.
RECOMMENDATION: It is recommended that the City Council approve Conditional Use Permit
KCU-15-06, with the four (4) conditions of approval.
FISCAL EFFECTS: Approval of the request would have minimal fiscal impact to the City.
ALTERNATIVES: Deny the request.

Kalispell City Planning Board and Zoning Commission, as the Council's findings of fact, and issues
and grants to the above -described real property a conditional use permit for a 24-hour "Assist"
healthcare facility at 1280 Burns Way, Kalispell, Montana in the Health Care, H-1 zoning district
subject to the following conditions:
That commencement of the approved activity must begin within 18 months from the date of
authorization or that a continuous good faith effort is made to bring the project to completion.
2. Signage shall comply with Chapter 27.22 of the Kalispell Zoning Ordinance.
3. The building permit application site plan and elevation drawings shall substantially comply
with the approved conditional use permit application site plan and elevations drawings.
4. The development shall receive Site Review Committee approval prior to issuance of the
building permit.

Summary of Request: The applicant is requesting a conditional use permit for a 24-hour "Assist" facility
within the H-1 (Healthcare) Zoning District. The facility will operate as an "Assist" facility, providing
care for patients that do not need to be in the hospital but are not ready to go home. No medical care or
healthcare services will be provided at the Assist center. Assist focuses on non -medical needs and
connecting the patient with needed resources available in Flathead County. Twenty-four hour care
facilities are permitted within the H-1 Zone provided a conditional use permit is obtained per Section
27.11.030 of the Kalispell Zoning Ordinance. The project involves renovating the interior of the building
currently used as Kalispell Medical Office and Bone Health. The main floor of the building will be
maintained as office space, the lower level will be converted to accommodate ten (10) new rooms for
patients No exterior renovations are proposed.
Existing Land Use and Zoning: The property is currently developed with the Kalispell Medical Office
and Bone Health building.

The property is located within the H-1 (Healthcare) Zoning District. The Kalispell Zoning Ordinance
describes the intent of this district:
"Provide hospital and medical facilities and supportive services for the care of the sick, elderly and
distraught. This zone is not intended to serve general retail or overnight accommodation needs of
the general public. This zoning district would typically be found in areas designated as Urban
Mixed Use on the Kalispell Growth Policy Future Land Use Map.
Adjacent Land Uses and Zoning: The existing zoning and land uses of the land surrounding the subject
property are as follows:

Relation to the Growth Policy: The Growth Policy 2020, Economy Chapter, states to strengthen Kalispell
as a regional healthcare center that provides a broad spectrum of healthcare related services, with diagnostic,
therapeutic and varied medical services available. Therefore, by providing additional 24-hour care services to
the community, the proposed renovation of the building into an "Assist" center is supported by the growth
policy.

B. EVALUATION OF THE REQUEST
This application has been reviewed in accordance with the conditional use review criteria in the Kalispell
Zoning Ordinance. A conditional use permit may be granted only if the proposal, as submitted, conforms to
all of the following general conditional use permit criteria, as well as to all other applicable criteria that may
be requested:
1. Site Suitability:
a. Adequate Useable Space: The subject property consists of two lots approximately 20,000
square feet in size. The minimum lot size requirement within the H-1 Zone is 7,000 square
feet. The property is currently developed with an office building that meets all the required
setbacks for the zone.
b. Height, bulk and location of the building: There is an existing office building onsite that
meets the required setback and height requirements. No exterior additions are proposed that
would increase the height, bulk or location of the existing building. All of the renovations will
be within the interior of the building.
C. Adequate Access: The Assist facility will accessed via Burns Way to the east. Burns Way is
an improved private street that meets the minimum width requirements for ingress and egress.
Access to the site can also be taken via the private parking lots to the south and west. These
parking lots gain access from Conway Drive to the north and Bountiful Drive to the south.
d. Environmental Constraints: There are no known environmental constraints, such as steep
slopes, streams, floodplains, or wetlands on the property, which could affect the proposed use.
The proposed Assist center will be within an existing building and only interior improvements
are proposed.

2. Appropriate Design:
a. Parking Scheme/Loading Areas: The number of parking stalls required for the building is
reduced with the proposed use since the bottom floor is being converted from office space to
patient rooms. However, the off-street parking and loading will not be changed as part of this
project. The configuration and number of stalls within all adjacent off-street parking lots
located to the north, south and west will not be changed. Handicap stalls dedicated to the
building are in the parking lot north of the building and accessible to the lower level via an
exterior handicap ramp.
b. Lighting_ Chapter 27.26 of the Kalispell Zoning Ordinance sets standards for all outdoor
lighting on commercial or residential structures.
Traffic Circulation: The Assist facility gains their access from Burns Way, which is an
improved private street. Access to the site can also be taken via the private parking lots to the
south and west. These parking lots gain access from Conway Drive to the north and Bountiful
Drive to the south.
d. Open Space: The Assist facility is proposed within an existing office building and no open
space is required for the change of use.
e. Fencing/Screening/Landscaping: No additional fencing, screening, or landscaping is
proposed. The property has mature landscaping on all sides of the building and will remain in
place.
f. Signage: The existing monument sign and building signage will remain in their current
location, but will be modified to display new tenant information. No additional signage is
proposed.
3. Availability of Public Services/Facilities:
a. Police: Police protection will be provided by the Kalispell Police Department. No unusual
impacts or needs are anticipated from the proposed Assist center.
b. Fire Protection: Fire protection will be provided by the Kalispell Fire Department. The
impact of the proposed change in this regard is minimal.
C. Water: City water currently serves the property. No impact on water services is anticipated
as a result of this use.
d. Sewer: Sewer service is currently provided by the city. No impact on sewer services is
anticipated as a result of this use.
Storm Water Drainage: The site has an existing office building. No change in storm water
drainage is anticipated related to the proposed use.
f. Solid Waste: Solid waste pick-up will be provided by the City. Existing refuse will not
change with the new use.

g. Streets: The primary street frontage is Burns Way, an improved private street. Access to
Burns Way is via a driveway into the parking lot located just north of the building.
h. Sidewalks: The property has sidewalks located along Burns Way. There are also sidewalks
that go to the parking lots to the south and west of the building.
i. Schools: This site is within the boundaries of School District #5. There are not any
anticipated impacts for the proposed use.
j. Parks and Recreation: There will be no significant increase in demand on the parks and
recreation programs and facilities as a result of this use.
4. Neighborhood impacts:
a. Traffic: The patients do not have cars so the only traffic generated by the use would be from
the employees of the Assist center. Accordingly, the amount of traffic associated with the
existing building could decrease with the new use.
b. Noise and Vibration: Other than during the interior renovation constriction, the Assist center
will not create any noise and vibration beyond what would normally be associated with a
healthcare office/care building.
C. Light, Dust, Glare, and Heat: Other than during the interior renovation construction, the Assist
center will not create any objectionable light, dust, glare, and heat beyond what would
normally be associated with a healthcare office/care building.
d. Smoke, Fumes, Gas, or Odors: Other than during the interior renovation construction, the
Assist center will not create any objectionable smoke, fumes, gas, or odors beyond what
would normally be associated with a healthcare office/care building.
e. Hours of Operation: An Assist employee will be on duty 24-hours a day seven days a week.
The Assist employees are not medical personnel, but individuals trained to provide care for
the Assist patients. The Assist patients will stay in a private room and it is anticipated that
their stay will be for a short period of time. Assist policies and procedures will prevent
referral of patients that have the potential for staying extending periods of time.
5. Consideration of historical use patterns and recent changes: The area of the proposed use can
be classified as healthcare based consisting of medical office, rehab and 24-hour care facilities
(hospital and Immanuel Lutheran). The subject property has been historically used as a medical
office. The change of use to an Assist center is an appropriate use for the location. The area is
constantly changing to meet the healthcare demands of the community and provide the necessary
services. There are no adjacent uses that would be negatively impacted by the proposed use.
6. Effects on property values: No significant negative impacts on property values are anticipated as
a result of the requested conditional use of the property.

C. RECOMMENDATION
The staff recommends that the Kalispell Planning Board adopt staff report #KCU-15-06 as findings of fact
and recommend to the Kalispell City Council that the conditional use permit be approved subject to the
following conditions:

INSTRUCTIONS FOR CONDITIONAL USE PERMIT APPLICATION
1. A pre -application meeting with the planning director or member of the planning staff
is required.
2. Submit the correct fee, (per schedule below) completed application and appropriate
attachments to the Kalispell Planning Department (address on the front of this form).
3. A certified list of all property owners within 150 feet of the subject property is
required with the information listed below. The list can be obtained from the Flathead
County GIS Office (see attached form), or from a title company. Please note: Streets
and roads are not included as part of the 150 feet.

A. Traffic flow and control:
1. Traffic flow will not be changed as part of this Conditional Use. Employees will be encouraged to park in
the existing West parking lot adjacent to Lot 11. Primarily, patients will be brought from this parking lot or
from the large parking lot to the South.
B. Access to and circulation within the property
1. Access to and circulation within the property will not be changed as part of this Conditional Use. Primary
access to the new ASSIST facility on the lower level of the building will be from the West or South parking
lots via the existing sidewalks. An existing exterior handicap ramp also connects the dedicated handicap
parking stalls located in the North parking lot to the lower level.
C. Off-street parking and loading
1. Off-street parking and loading will not be changed as part of this Conditional Use. The configuration and
number of stalls within all adjacent off-street parking lots will not be changed. Handicap stalls dedicated to
this building are in place in the North parking lot and accessible to the lower level via an exterior handicap
ramp. Patient meals will be delivered directly to the Food Prep room via the South lower level entrance.
Delivery vehicles for this service may be parking in either the existing West or South parking lots.
D. Refuse and service areas:
1. Existing refuse and service areas will not be changed as part of this Conditional Use.
E. Utilities:
I . Existing utilities will not be changed as part of this Conditional Use. A fire suppression sprinkler system

Burns Way.

mature landscaping on all sides of the building that will remain in place. One shrub will be removed during
the fire suppression trenching. It's unknown at this time if the shrub will be replaced.

monument sign and building signage will remain in their current locations but may be modified to display
the new Tenant information. The building currently has vast amounts of open yard or parking lot space

MISSION
Assisting Men and Women in Recovering From Illness and Regaining Their Independence
DESCRIPTION OF BASIC SERVICES
The services of ASSIST begin with a physician, nurse, or social worker observing a patient who
may be unable to regain his or her health after being discharged from a hospital, nursing home or
medical clinic. The patient is informed of the help that ASSIST can offer, and if the patient is
receptive, the name and phone number of the patient (then referred to as a Care Receiver) is given
to the Director of ASSIST.
The Director of ASSIST makes contact with the Care Receiver either before he or she leaves the
hospital, nursing home or medical clinic or makes the initial visit at the residence of the Care
Receiver. During the initial visit, the Director of ASSIST, along with the ASSIST Volunteer,
detennine the needs with the Care Receiver and develop a "Program for Recovery." The needs
determined generally go beyond the needs identified by the physician, nurse or social worker.
ASSIST does not provide medical care or other health care services. ASSIST services focus on
non -medical needs, connecting the Care Receiver with needed resources available in Flathead
County. The help made available to a Care Receiver varies greatly and depends on his or her needs.
The ASSIST Director and ASSIST Volunteers provide assistance in connecting the Care Receiver
with help available and completing applications for the help that is needed including: food, better
housing, transportation, financial assistance for medicine and to pay monthly bills, housekeeping
and other social services. An important part of the care provided is ensuring that the Care Receiver
has someone who cares and goes along side of the Care Receiver in obtaining the help required.
ASSIST Volunteers maintain contact with the Care Receivers until they are well on their road to
regaining health and independence. Upon completion of services provided, the Director of
ASSIST meets with the Care Receiver to conduct an exit interview.
The ASSIST Center
The application for Conditional Use Permit is for The ASSIST Center.
The ASSIST Center serves two purposes. First, the offices for the employees of ASSIST who are
responsible for BASIC SERVICES as described above. Second purpose is to provide rooms for
patients in transition from hospital to home. This second purpose is described in the following
paragraphs.
ASSIST has identified a new and pressing need. At times, a patient could be discharged from
hospital or nursing home but is not ready to make the transition to his or her home. So the patient
remains in the medical facility longer than may be required or allowed by third -party payers.
ASSIST has developed a solution for this need.
Rather than going to a nursing home or prematurely going home, the patient will be transferred to
The ASSIST Center, which provides a private room free of charge for the patient. The patient will
be first discharged from the medical facility and then transferred to Tlie ASSIST Center. The
patient will be allowed to stay at The ASSIST Center while recovering adequately to return to their
home.
Another type of patient that will be eligible for a stay in Tdie ASSIST Center are individuals who
require one medical procedure done each day for a period of time. The doctor does not want the
patient to return to their home during the period of the medical procedure. These patients do not
require the sophisticated care given in a hospital or nursing home.
Patients referred to The ASSIST Center are called "Care Receivers." Upon arriving at The
ASSIST Center, the Care Receiver will be interviewed by the Director of ASSIST and an ASSIST
Volunteer to determine the Care Receiver's needs. The Director and ASSIST Volunteer will aid
in the Care Receiver's transition to their home.
It needs to be emphasized that this service is not for homeless patients. It is anticipated the stay in
The ASSIST Center will be for a short duration. Policies and procedures will govern the type of
patients referred to The ASSIST Center and these policies and procedures will prevent referrals
of patients who have the potential for staying extended periods of time.
No.medical care or other health care services will be provided for Care Receivers at TheASSIST
Center. Each Care Receiver will have a private room and three meals a day. An ASSIST
employee will be on duty twenty-four hours a day and seven days a week. The ASSIST employees
are not medical personal, but individuals trained to provide for the Care Receivers. Such care will
include helping Care Receiver bath and dress, helping with meals and being available for requests
by the Care Receiver. The ASSIST employees will also be responsible for security at The ASSIST
Center.

CALL TO ORDER AND ROLL
The regular meeting of the Kalispell City Planning Board and
CALL
Zoning Commission was called to order at 7:00 p.m. Board
members present were: Chad Graham, Charles Pesola, Matt
Regier, Steve Lorch, Karlene Osorio-Khor and Doug Kauffman.
Rory Young was absent. Tom Jentz, Jarod Nygren and PJ
Sorensen represented the Kalispell Planning Department.
APPROVAL OF MINUTES
Osorio-Khor moved and Lorch seconded a motion to approve the
minutes of the December 8, 2015 meeting of the Kalispell City
Planning Board and Zoning Commission.
VOTE BY ACCLAMATION
The motion passed unanimously on a vote by acclamation.
PUBLIC COMMENT
None.
WILSON CONDITIONAL USE
A request from Rebecca Wilson, for a conditional use permit to
PERMIT
add 432 square feet to the north end of the existing second single-
family residence, located at 233 1/2 3rd Avenue East, within the
RA-1 (Residential Apartment) Zoning District.
STAFF REPORT — KCU-15-07
Jarod Nygren, representing the Kalispell Planning Department
reviewed Staff Report KCU-15-07 for the board.
Nygren noted the primary residence was constructed in 1930 and
the 2" d residence was constructed in 1943. Two primary uses are
permitted within the RA-1 zone provided a conditional use permit
(CUP) is obtained. At the time the 2nd residence was constructed a
CUP was not required however, due to the expansion of the
residence a CUP is now required.
Nygren continued the existence of the two homes on one lot is a
legal non -conforming use since the 2rid residence was constructed
prior to when the zoning ordinance was put in place.
Nygren reviewed the site plan and aerial photograph and he noted
the requirement for a 20 foot rear setback is in order to maintain a
parking space for the 2nd residence. He also reviewed the
surrounding zoning and land uses. The Kalispell Growth Policy
Map designates this property as Urban Mixed Use.
No public comments have been received.
Staff recommends that the Kalispell City Planning Board and
Zoning Commission adopt staff report KCU-15-07 as findings of
fact and recommend to the Kalispell City Council that conditional
use permit be approved subject to the 3 conditions listed in the

THE ASSIST CENTER
A request from Marise Johnson, for a conditional use permit for a
CONDITIONAL USE PERMIT
24-hour healthcare facility within the H-1 (Healthcare) Zoning
District, located at 1280 Burns Way. The facility will operate as an
"Assist" facility, providing care for patients that do not need to be
in the hospital but are not ready to go home.
STAFF REPORT KCU-15-06
Jarod Nygren, representing the Kalispell Planning Department
reviewed staff report KCU-15-06 for the board.
Nygren said no medical care or health care services will be
provided at The Assist Center as it focuses on non -medical needs
and connecting the patient with needed resources available in the
county. Nygren provided an example for the board where a
resident lives in Libby and needs daily follow-up visits with their
doctor and so would stay in this facility for a week or so.
Nygren continued 24 care facilities are permitted within the H-1
zone provided a conditional use permit is obtained. The main
floor of the building will be maintained as office space and the
lower floor will be converted to accommodate ten new rooms for
patients and no exterior renovations are proposed.
Nygren reviewed a site plan of the project and noted a new
sidewalk has been added along the property boundary on the east
side and there is also a pathway that connects this building to a
parking lot to the south. He also reviewed the surrounding zoning
and land uses and noted the Growth Policy supports this use.
One letter (copy attached to these minutes) was received from the
public that primarily addresses concerns with ADA access,
pedestrian access and parking. Nygren said ADA issues will be
addressed by the Kalispell Building Department through the
building permit plan review process; pedestrian access now
includes the sidewalks mentioned above and the pathway to the
parking lot. The city would not be able to require this developer to

extend sidewalk to Claremont Street, just along the property itself,
which they have already done. This use requires less parking than
the former office use at 2 parking spots required compared to 12-
13 spaces for the office use.
Nygren noted a typo in the staff report on page 4, under traffic, it
states the "senior living facility" and it should state "the Assist
facility".
Staff recommends that the Kalispell City Planning Board and
Zoning Commission adopt staff report KCU-15-06 as findings of
fact and recommend to the Kalispell City Council that the
conditional use permit be approved subject to the 4 conditions as
amended.
BOARD DISCUSSION
Osorio-Khor noted Margaret Davis, the homeowner who wrote the
letter, has written to the planning board before and she is very
efficient and accurate and it is always good to get her input.
Osorio-Khor added the majority of her concerns will be dealt with
through the permitting process and not dealt with at the planning
board level and Nygren said that is correct and explained further.
Osorio-Khor continued Marise Johnson is and outstanding woman
and was one of only two female physicians in this town at one
time and her family has always been dedicated to medicine and
health care for this community.
She added this use is so needed especially since the hospital is a
regional hospital where people are coming from all areas.

MOTION
Lorch moved and Kauffman seconded a motion to adopt staff
report KCU-15-06 as findings of fact and recommend to the
Kalispell City Council that the conditional use permit be approved
subject to the 4 conditions listed in the staff report.
BOARD DISCUSSION
Lorch said he read Ms. Davis' letter and added the purpose of
conditional use permits in situations like this is to mitigate impacts
that are off -site of the existing project. What they are proposing to
do here is all contained within the building and the parking
situation will be less of an impact, and any other impacts off -site
would be addressed through the conditions. He is comfortable
with the staff's report and review.

to the Growth Policy.

WORK SESSION:
Following the regular meeting a work session was held on the
following:
New B-3 Zoning District for the Core Area — In an effort to begin
the implementation of the Core Area Plan, staff has created a B-3
Zoning District. This zone is based primarily on the Core Area
Plan and is intended to further the goals and policies in the plan.
The B-3 Zone is a mixture of the B-2 and B-4 Zones and includes
uses and standards that are intended to implement the plans vision.
In summary, the B-3 Zone includes the following components:
• Allows multi -family.
• Allows retail and office.
• Limits industrial uses.
• No setback requirements.
• Increased permitted height.

9, 2016 beginning at 7:00 p.m. and located in the Kalispell City
Council Chambers, 201 1st Avenue East, Kalispell.
