Resolution 3304 - Amended Plat - Hawthorne WestRESOLUTION NO. 3304 A RESOLUTION TO APPROVE THE REDESIGN AND AGGREGATION OF LOTS WITHIN HAWTHORN WEST 111, SUBDIVISION 0108, AND AUTHORIZE FILING OF AMENDED PLAT THEREFOR. WITNESSETH: WHEREAS, on October 15, 1979, by Resolution 93265, the Kalispell City Council did approve as a subdivision of the City a portion of Lot 6 of Porta Villa Subdivision #3, to be known as Hawthorn West III, Subdivision #108,, with certain termer and conditions of approval there- fore set out therein; and WHEREAS, it appears that said terms and conditions were met and a final plat for said subdivision was duly filed with the Flathead County Clerk and Recorder; and WHEREAS, it is now the desire of the owners of Lots I through 6 of said Hawthorn West III, Subdivision #108, to redesign and aggre- gate said six lots into four lots to be hereafter known as Lots A, B, C and D of said Subdivision; and -WHEREAS, it appears reasonable and proper that such redesign and aggregation of Lots 1, 2, 3, 4, 5 & S,into Lots A, B, C & D does not adversely effect the City nor the Criteria for approval as set forth in Sec. #76-3-608, M.C.A., and which was adequately considered when said Resolution #3265 was adopted; and WHEREAS, the Council has been advised by the Advisory Technical Staff, Flathead Regional Development Office, that said redesign and agcjregation of lots is in compliance with the Hawthorn West Master Plan, previously approved by the council; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: 1) Re -design of Lots 1, 2, 3, 4, 5 & 6 of Hawthorn West III, Subdivision #108, and aggregation of same into four lots to be hereafter known as Lots A, B, C & D of said Sub- division 4108 in accord with the preliminary plat there- fore furnished to the Kalispell City Council is hereby approved and a final amended plat therefor in'the same design and aggregation shall be prepared and filed with the Flathead County Clerk and Recorder as required by Sec. #76-3-207(-2)(-a), M.C.A. 2) All other terms and conditions, including zone classifi- cation, as set out in Resolution 43265 applicable to all of said Hawthorn West III, Subdivision #108, shall re- main in full force and effect.
