Resolution 3285 - SID 328 Assessment
179 RESOLUTION NO. 3285 A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 328 TO DEFRAY THE COSTS OF MAKING THE SPECIAL IMPROVEMENTS AUTHORIZED THEREIN. BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS POLLOWS: To defray the costs of making the special improvements authorized in that area included within Special Improvement District No. 328 of the City of Kalispell, as more particularly described,in Reso- lution No. 3237 dated May 7, 1979, and on file in the office of the City Clerk, there is hereby levied and assessed against all said property a tax in the total sum of $ 300,020.00 _, plus interest as hereinafter provided. Said sum includes all costs of making said improvement and as allowed by Section 7-12-4169, MCA, and as certi- fied to the City Clerk by the Director of Public Works upon comple- tion and acceptance of said improvements. Said levy and assessment as is made hereunder against each lot or parcel,of land within said district also shall include accruing interest thereon at the rate of 8.70 % until paid from the date of registration of bonds sold and issued in accord with,Resolution No. 3239, dated May 7, 1979, and if same is not paid in full when so levied and assessed, said sum shall, with interest at _1.70 %, be spread over a term of not to exceed twenty (2Wyears, payments to be made in equal annual installments as provided by Resolution No. 3239 dated May 7, 1979. Each lot or parcel of land within said district shall be assessed for that part of the aforesaid whole cost which its area bears to th,zs area of the entire district, exclusive of streets, avenues, alleys and public places. The description of each said lot or parcel and the name of its owner, and the amount of each partial payment to be made and the date when the same shall bec6me delinquent is sel,' forth on Exhibit A, attached hereto and which, by this reference, do�:i; become a part hereof. The City Clerk is hereby directed to publish Notice hereof as provided by Section 7-12-4177, MCA. This council will meet and hear any objections to said levy and assessment and take final action thereon at the regular meeting of the City Council at the Council Chambers, Kalispell City Hall, commencing at 7:30 P.M. on the 2nd day of June , 1980; said Notice shall so provide. Kalispell, Mono tana, was filed in the office of said Clerk of the Council on the 21st day of April , 19 80 , and has since that date Been on file in said office, subject to inspection, and the Clerk of the Council having given notice of the passing and filing of said Resolution by publication in the Daily Inter Lake, a newspaper printed and published in the City of Kalispell, Montana, at least five days before the date set herein for hearing objections thereto, and the City Council having been in session at the time and place for the hearing of objections, and no owner, or agent of any owner of lots, pieces, or parcels of land situated within said Special Improvement District No. 328 or any other person, having appeared and protested against or objected to the final. -passage and adoption of said Reso- lution or to any assessment or tax hereby levied or assessed; and it appearing to the satisfaction of the City Council that the cost of the improvements within the said Special Improvement District No. 328 was necessary and proper, and that the cost thereof should be assessed accordingly as in said resolution provided; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KALIS"PELL, MONTANA, AS 'FOLLOWS: That the within and foregoing Resolution No. 3285 be and the same is hereby finally passed and adopted, and the said assessments therein provided for, and all thereof,,be and the same are hereby levied and assessed accordingly, and that the first of said assess- irrJ its are now due and payable to the City Treasurer of the City of lispell, Montana, and same will become delinquent on December 1 i 19 80 , at 5:00 P.M. of said day, and hereafter the .rr'�ual payments as required shall become delinquent on the last day of November of the year for which said annual amount is due at 5:00 k>, NM, of said day. The City Clerk is also hereby ordered to deliver to the Kalispel City Treasurer a certified copy of this and the within and foregoing Resolution No. 3285 within two days after its passing.
