Resolution 3278 - Subdivision - Lot 59, Park View TerraceRESOLUTION NO. 3278 A RESOLUTION TO APPROVE, AS A SUBDIVISION OF THE CITY OF KALISPELL, THE RESUBDIVISION OF A PORTION OF LOT 59, PARK VIEW'TERRACE ADDITION OF THE CITY OF KALISPELL, TO BE KNOWN AS RESU8DIVISION LOT 59 PARK - VIEW TERRACE ADDITION NO.__I, SUBDIVISION NO. 115,__ OF THE CITY OF KALISPELL. W, I T N E S S E T H. WHEREAS, Tom R. Wiggin and William W.-Walker the owner of Lot 9, Par View Terrace A ition No. 1, o the City of Kalispell, has petitioned for the approval of the resubdivision of said premises to be known as Resubdivision Lot 59, Parkview Terrace Addition No. 1, Subdivision No.-115, and —all persons having an interest in said premises have, in writing, consented to the resubdivision of said premises, as required by Section 76-3-613 M.C.A, and WHEREAS, said resubdivision does qualify for summary review and approval under the provisions of the Subdivision Regulations of the City of Kalispell as now'in effect, and WHEREAS, said Flathead County Areawide Planning Organization has recommended the City approve such,resubdivisions, and WHEREAS,. the City Council, in considering this request has found, from the preliminary plat and evidence relating thereto, that said resubdivision is in the public interest, and in making --och f ihding, the Council has considered and weighed (a) the basis the need for the subdivision; (b) expressed,public opinion; effects on agriculture; (d) effects on local. services; (e) effec oll 1:axation; (f) effects on wildlife habitat, and (h) effects on the �pi.i'.Jic health and safety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, SECTION 1. The Petition Of Tom R.' Wiagin and William _y-. _Halker,_ Park forthe resubdivision of Lot 59, P rk View Terrace Addition No. I is hereby -approved and same shall ereafter.be known as Resubdivision Lot 59, Parkview Terrace Addition No. 1, Subdivision No. TT5, of the -C- ity- of Kalisj�p—ll, Montana. SECTION 2.- The classification of said premises under the Kalispell Zoning ordinance shall not be changed by this action. SECTION 3. That no portion of said premises need be dedicated to the City for park purposes, and, in accord with Section 76-3-606 M.C.A., said petitioner shall forthwith pay to the City of Kalispell for 'park purposes, in lieu thereof, the 'sum of $_zra, mince park -,Le qiAirement was met *,when addition was --i—nally—subdiviAe�—.— SECTION 4. Upon payment of the aforesaid sum for park purposes, and upon proper filing of the final plat of said resi.ibdivision.in the office of the Flathead County Clerk and Recorder, said promises shall be a subdivision of the City of Kalispell.
