A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF
KALISPELL, TO BE KNOWN AS DOUBLE LL ADDITION NO. 76, AND TO FIX
THE DATE OF PUBLIC HEARING THEREON; TO PROVIDE FOR PUBLICATION
OF NOTICE OF SAID HEARING.
WHEREAS, Raymond Lembke and Eugene Lenz have made petition
to the City of Kalispell for annexation to said City of certain
territory to be known as Double LL Addition No- 76; and
WHEREAS, a preliminary plat thereof has been reviewed and
considered in accord with the laws of the State of Montana and
the subdivision regulations of the City of Kalispell by the
Kalispell City -County Planning Board and said Board has, by
communication dated October 11, 1979, recommended that said peti-
tion be granted under certain conditions; and it appears that said
conditions are or will be adequately satisfied, and that it is
to the best interest of the City of Kalispell that said petition
be granted,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KALISPELL, AS FOLLOWS:
1. It is the intention of the City of Kalispell that
territory comprising Double LL Addition No. 76 shall be annexed
to the City of Kalispell, and the easterly 290 feet of said tract
shall be classified a Neighborhood Business B-1 Zone District and
the remainder a Residential Apartment RA-1 Zone District. Said
territory is more particularly described as follows:
That portion of the Southeast Quarter of the Northeast
Quarter (SE4NE'), of Section 12, Township 28 North, Range
22 West, Flathead County, Montana, described as follows:
Commencing at a point on the East line of the Northeast
Quarter, Section 12, which point is 1.39 feet north of the
Northeast corner of the Southeast quarter Northeast quarter;
thence along the East line of the Northeast Quarter South
0'46'00" East 825.14 feet (827.0 feet Record); thence
South 89039'02" West 29.49 feet (South 89'40' West 30.0 feet
Record) to the westerly line of Meridian Road, at the point
of beginning; thence continuing South 89139'02" West 594.03
feet (South 89040' West 593.2 feet Record); thence South
0*22'33" East 275.49 feet (South 0024130" East 275.5 feet
Record); thence North 89042122" East 345.49 feet (North
89040' East 344.9 feet Record); thence North 0045158" West
137.87 feet (North 0*461 West 137.5 feet Record); thence
North 89038'38" East 250.15 feet (North 89040' East 250.0
feet Record); to the Westerly line of Meridian Road; thence
along the Westerly line North 0'39115" West 137.93 feet
(North 0*461 West 138.0 feet Record) to the point of
beginning.
2. A public hearing on said petition for annexation will
be held by the Kalispell City Council at its regular meeting held
in the Council Chambers of the Kalispell City Hall commencing at
7:30 P.M. on December 3,'1979.
3. The City Clerk will forthwith prepare and publish in the
Daily Inter Lake, a daily newspaper published at Kalispell, Mon-
tana, proper notice of said public hearing. Said petitioners
shall pay all costs of publication of said notice.
