Resolution 3269 - Subdivison - Brown's AddnNO.3269 A RESOLUTION TO APPROVE, AS A SUBDIVISION OF THE CITY OF KALISPELL, THE RESUBDIVISION OF A PORTION -OF BRaN'S ADDITION TO KVTSPELL, OF THE CITY OF KALISPELL, TO BE KNOWN AS RESUBDIVISION OF LOT 1, BR0`,-N.'S ADDITION TO KALISPELL, SUBDIVISION NO. 109, OF THE CITY OF KALISPELL. W. I T N E S S R T H -. WHEREAS# Leahman ft. Brown & Cecile M. Brown, husband & wife, tenants in ooffoon, the owners of r rowri s i �10n 0 �alsP�ee of tine City o ICalispel7, has petitioned for the apj,-7r-.v.j of the resubdivision of said premises to be known as AdditiCn to Kalispell, S13bd!_=Jnn No- -1091, and all persons having an interest in said premises have, in writing, consented to the resubdivision of said premises, as required by Section 76-3-613 M.C.A, and WHEREAS, said resubdivision does qualify for summary review and approval under the provisions of the Subdivision Regulations of the City of Kalispell as now'in effect, and WHEREAS, said Flathead County Areawide Planning Organization has recommended the City approve such,resubdivisions, and WHEREAS, the City Council, in considering this request has found, from the preliminary plat and evidence relating thereto, that said resubdivision is in the public interest, and in making such fiiiding, the Council has considered and weighed (a) the basis of the need for the subdivision; (b) expressed public opinion; (c) effects on agriculture; (d) effects on local services; (e) effects on '.axation; (f) effects on wildlife habitat, and (h) effects on the VuIAI,ic health and safety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF' KALISPELL, MONTANA, SECTION 1. The Petition of leahman H. Brown and -iereby approved and same shall hereafter be known as Lot 1, Brown's Addition to Kalispell., Subdivision No. 109 U-17fie city of Kalispell, Montana. 8- ' PAGE36 BOOK 6 8 SECTION 2.- The classification of said premises under the Kalispell Zoning ordinance shall not be changed-bythis action. SECTION 3. That -no portion of said premises need be dedicated to the City for park purposes, and, in accordwith Section 76-3-606 M.C.A., said petitioner shall forthwith pay to the City of Kalispell for *park purposes, in lieu thereof, the sum of $ -none- SECTION 4. Upon payment of the aforesaid sum for park purposes, and upon proper filing of the final plat of said resubdivision in the office of the Flathead County Clerk and Recorder, said premises shall be a subdivision of the City of Kalispell.
