Resolution 3225 - Subdivision - Hall AddnTHE RESUBDIVIS ION OF A PORTION OF HALL ADDITION NO. 82 67F-THE CITYOFKALISPELL, TO BE KNOWN AS RESUBDIVISION:OF 11 ADDITIO" NO- 29- ADDITION NO. 98 F THE CITY OF KALISPELL. Resolution 3225 W- I T N E S S E T H: WHEREAS, Oscar H. Olson and Marlys Olson, husband and wife, the owner of 'Lot 1, Hall Addition No. 82 of the City of Kalispell, has _petitioned for the approvalof the resubdivision of said premises to be known as Resubdivision of Lot 1, _._ffa_lj-_Addition No. 82, Addition No. 98, and all persons havinganinterest in said premises have, in writing, consented to the resubdivision of said premises, as required by Section 76-3-613 M.C.A, and WHEREAS, said resubdivision does qualify for summary review and approval under the provisions of the Subdivision Regulations of the City of Kalispell as now in effect, and WHEREAS, said Flathead County Areawide Planning organization has recommended the City approve such resubdivisions, and WHEREAS, the City Council, in considering this request has found, from the preliminary plat and evidence relating thereto, that said resubdivision is in the public interest, and in making such finding, the Council has considered and weighed (a) the basis of the need for the subdivision; (b) expressed public opinion; (c) effects on agriculture; (d) effects on local services; (e) effect on taxation; (f) effects on wildlife habitat, and (h) effects on the publ,.11.c health and safety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, SECTION 1. The Petition of Oscar H. Olson and Marlys Olson, husband and wife, for the resubdivision of Lot 1, Hall Addition No. 820 i"s hereby approved and same shall ereafter be known as Resubdivision of Lot 1, Hall Addition No. 82, Addition No_._� of the City of .Kalispell, Montana. SECTION 2. The classification of said premises under the Kali<;pell Zoning ordinance shall not be changed by this action. SECTION 3. That no portion of said premises need be dedicated to the City for park purposes, and, in accord with Section 76-3-606 M.C.A., said petitioner shall forthwith pay to the City of Kalispell for *park purposes, in lieu thereof, the sum of $NONE - It is noted, however., that the provisions of the covenants, con a-irions --a-na-r--e-sri-c- ons as, . Upon payment of the aforesaid sum for park purposes, and upon proper filing of the final plat of said resubdivision in the office of the Flathead County Clerk and Recorder, said premises shall be a subdivision of the City of Kalispell.
