Resolution 3198 - Support for Kat's Indoor PoolRESOLUTION NO. 3198 A RESOLUTION TO EXPRESS THE INTENT OF THE CITY COUNCIL TO PERMIT THE KALISPELL KAT'S TO BUILD AN INDOOR SWIMMING POOL FACILITY ON CITY PROPERTY. WITNESSETH: WHEREAS, the City owns land on Airport Road and described hereafter in Exhibit "A", which is suitable for development as a public park facility, and WHEREAS, a non-profit association known as the "Kalispell Kat's", consisting of persons interested in furthering competitive swimming, diving and other aquatics and in stimulating the public interest in and appreciation of aquatic activities, has proposed to the City a plan to construct at their expense an indoor swimming and diving facility on such property and thereafter operate same for the general public benefit under lease from the City, and WHEREAS, it appears to the City Council that such a plan is feasible and in the positive interests of the City and that such a development is for the public good, NOW THEREFORE, BE IT RESOLVED that it is the intent of the City to allow the Kalispell Kat's to construct an indoor swimming and diving facility on land owned by the City more particularly described in Exhibit "A" attached hereto and which, by this refer- ence, is incorporated herein. To implement the intent expressed by this Resolution the said Kalispell Kat's must present to the City Council for its review and approval within one (1) year of the date hreof, an acceptable plan for such facility. Further, it is the understanding of the City Council that the Kalispell Kat's will bear the full cost of construction of said facility as well as all maintenance and operation costs under any lease thereof from the City. Should the Kalispell Kat's fail to present an acceptable plan for the construction and financing of said facility within one(l) year c,.,f the date hereof, the intent of the City as expressed here- by shall terminate.
