RESOLUTION NO. 3240
A RESOLUTION TO APPROVDE, AS A SUBDIVISION OF THE CITY OF KALIS-
PELL, THE SUBDIVISION OF HENDRICKSON ADDITION NO. 70 OF THE CITY
OF KALISPELL, TO BE KNOWN AS HENDRICKSON ADDITION NO. 70, SUB-
DIVISION NO. 102, OF THE CITY OF KALISPELL.
WITNESSETH.
WHEREAS, Tom Moe, Sonja Moe, Eldon A. Streich and Alyce M.
Streich, the owners of Hendrickson Addition No. 70 of the City
of Kalispell, have petitioned for the approval of the subdivision
of said premises to be known as Hendrickson Addition No. 70,
Subdivision No. 102 of the City of Kalispell, and all persons
having an interest in said premises have, in writing, consented
to the subdivision of said premises, as required by Section
76-34-613 M.C.A., and
WHEREAS, said subdivision does qualify for summary review
and approval under the provisions of the Subdivision Regulations
of the City of Kalispell as now in effect, and
WHEREAS, said Flathead County Areawide Planning Organization
has recommended the City approve such subdivisions, and
WHEREAS, the City Council, in considering this request has
found, from the preliminary plat and evidence relating thereto
that said subdivision is in the public interest, and in making
such finding, the Council has considered and weighed (a) the basis
of: tho need for the subdivision; (b) expressed public opinion;
(c) effects on agriculture; (d) effects on local services; (e)
effects on taxation; (f) effects on wildlife habitat, and (h)
effects on the public health and safety.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA,
SECTION 1. The petition of Tom Moe, Sonja Moe, Eldon A.
Streich and Alyce M. Streich for the subdivision of Hendrickson
Addtion No. 70 is hereby approved and same shall hereafter be
known as HENDRICKSON ADDITION NO. 70, SUBDIVISION NO. 102, of
the City of Kalispell, Montana.
SECTION 2. The classification of said premises under the
Kalispell Zoning Ordinance shall not be changed by this action.
SECTION 3. That no portion of said premises need be dedicated
to the City for park purposes, and, in accord with section 76-3-606
M.C.A. said petitioners shall forthwith pay to the City of Kalispell
for park purposes, in lieu thereof, the sum of $200.00.
SECTION 4. Petitioners shall also: a) install a fire hydrant
to the specifications of the City Director of Public Works to
serve Lot 3; b) furnish to the City forthwith a waiver of protest
to the formation of a special improvement district for sanitary
sewer and storm drain to serve said subdivision; and c) obtain
the approval of the Montana State Board of Health for the current
sewage disposal system to be utilized on the premises.
SECTION 5. Upon payment of the aforesaid sum for park pur-
poses, and upon proper filing of the final palt of said subdivision
in the office of the Flathead County Clerk and Recorder, said

premises shall be a subdivision of the City of Kalispell,
PASSED AND APPROVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
KALISPELL, THIS 21 Y day of 1979.
