A RESOLUTION TO APPROVE AS A SUBDIVISION OF THE CITY OF KALISPELL,
MONTANA, UNDERHILL SUBDIVISION NO. 2, ADDITION NO..77.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, 14ONTANA:
SECTION 1. That pursuant to the petition of Howard V. Doran and
Irene V. Doran, filed with the City Council of the City of Kalispell,
and the submission to said Council by said petitioners of a plat
reflecting the survey and designation of that territory within
the City of Kalispell which said petitioners request he approved
as a subdivision therein, and pursuant to those provisions of
Chapter 38, Title 11, R.C.M. 1947, as amended, that are applicable
thereto and the duly adopted and enforced subdivision regulations of
'the City of Kalispell, the Council and Mayor do hereby approved that
said territory shall become and be a subdivision of the City of
Kalispell to be known as:
UNDERHILL SUBDIVISION NO. 2, ADDITION NO. 77.,
SECTION 2. The Council.has accepted, in accordance with Title 11,
Chapter 38, R.C.M. 1947, cash in lieu of park land requirements.
It is ordered that the amount to be paid to the City in lieu of
the park requirement is $1,248.00 , which shall be deposited in
the Park Fund of the City to be used according to law.
SECTION 3. The City Councl, in considering this request, has found
from the preliminary plat and evidence relating thereto, that said
subdivision is in the public interest, and in making such finding,
the Council has considered and weighed: (a) basis of need for the
subdivision; (b) expressed public opinion; (c) effects on
agriculture; (d) effects on local services; (e) effects on
taxation; (f) effects on wildlife habitat; and (h) effects on
the public health and safety.
SECTION 4. As a consideration of said approval, however, the
petitioners agree to the following terms and conditions: (a) all
sewer and water lines within the subdivision will be required to be
constructed to city specifications; (b) furnish a 15 foot easement
for sewer line along the line joining Lots 13 and 14, and Lots 7 and
8 of Block 3, Underhill Subdivision, for connection of said sewer
with existing city sewer system; (c) Furnish to the City a general
right of way easement across a 51 foot strip shown on the plat as
parcels "C" and "D" between Lots 7 and 8, or convey said parcels
to the City, or furnish the City with an agreement to do so upon
demand of the City, it being understood that said land be for orderly
street and traffic purposes to join Underhill Subdivision No. 2 with
any future annexation to the north; (d) Establish a 10 foot utility
right of way on a line between Lots 1 and 2, between Lots 1 and 4 and
between Lots 2 and 3; (e) Pave the dedicated streets and install
curbs an rs to city standards within 2 years; furnish the city
