A RESOLUTION TO ALTER AND AMEND THE PLANS AND.SPECIFICATIONS OF CONTRACT
WITH PACK AND COMPANY, INC. ON FIRST AVENUE EAST STORM DRAIN IMPROVMENT
PROJECT.
WHEREAS, the City did, on July 22, 1976 enter into a contract with
Pack and Company, Inc. of Kalispell, Montana for construction of storm
drain improvements on First Avenue East; and
WHEREAS, upon the advice and recommendation of Thomas, Dean & Hoskins,
Inc., who is the City's consultant and engineer on said project, certain
changes and alterations in the drainage system are necessary because of a
drainage problem. This change order will correct this problem. Said
changes and alterations have been found necessary and adviseable and in the
best interests of the City; and said changes and alterations could not
have been necessarily foreseeable when the original design and specificat-
ions were prepared on the construction of the storm drain project. Said
changes are contained in Exhibit "A" attached hereto and is by this
refeence made a part hereof; and
WHEREAS, it appears in the best interests of the City to approve said
changes and alterations;
NOW THEREFORE, pursuant to the provisions of Section 11-1204, R.C.M.,
1947 be it hereby resolved;
1. The alterations and modifications of the specifications and plans
of the contract between the City of Kalispell and Pack and Company, Inc.,
dated July 22, 1976, as set out in Exhibit "A" attached hereto, and is
hereby approved; and
2. As soon as the price to be paid for said alterations and modificat-
ions are agreed to in writing, signed by the contractor and approved by the
Council, this approval thereof shall be in effect.
