Resolution 3062 - Construction Bids - 1st Ave E Storm Sewer
RESOLUTION NO. 3o62 A RESOLUTION PROVIDING FOR THE CALL FOR CONSTRUCTION BIDS FOR FIRST AVUE EAST STORM SEWER PROJECT. WHEREAS, the Mayor and City Council of the City of Kalispell, in compliance with the statutes of the State of Montana, did, on the 21st day of June, 1976 receive and award sale of $4 5,000.00 Sewerage System Revenue Bonds, Series 1976 for the purpose of constructing a storm sewer system on First Avenue East in accordance with the terms and conditions as specified in Resolution No. 3057; and W.EIEREAS, Thomas, Dean & Hoskins, Engineering Firm, 1200 _ 25th Street South, Great Falls, Montana, has submitted plans of said construction, and same have been approved by the City Engineer of the City of Kalispell; NOW 'PI3I;REE'011E, be it resolved: 1. That the City Clerk forthwith call for bids for said construction in accord with the laws of the State of Montana. 2. That the Notice of said call for bids be in the substantial form of and contain the provisions of Exhibit "A" attached hereto. I, the undersigned, City Clerk of b'City of a true copy of the Resolution dul passed by Montana at a regular meeting hel June t pelf certify hatythe foregoing is ty Council o 11#1e, City of Kalispell, of Exhibit tlA,r Resolution No. 3062 2 7 (1) ADVERTISEMENT FOR BIDS CONSTRUCTION OF STORM DRAIN IMPROVEMENTS The City of Kalispell will receive sealed bids for the Construction of Storm Drain Improvements to meet or exceed the minimum specifications on file in the office of the City of Kalispell, Director of Public Works. Bids will be received by the City Clerk until 7:30 P.M. July 120 1976, at which time all bids will be publicly opened and read aloud during the special meeting of the City Council, in the Community - Room of the Conrad National Bank on said date. Proposals shall be addressed to the City Clerk, P. 0. Box 1035, Kalispell, Montana 59901, and entitled "Bid for Construction of Storm Drain Improvements." All bids must expressly covenant that if the bidder shall be awarded the contract the bidder will, within 10 days after such award, enter into a formal contract and give good and sufficient bond to secure the performance of the terms and conditions of the contract; otherwise, the bidder shall pay unto the City of Kalispell the difference in money between the amount of the bid of the said bidder and the amount for which the City of Kalispell legally contracts with another party to construct, said improvements if the latter amount is more than the former, but in no event shall the bidder's liability or the liability of the surety of such bidder exceed the penal sum of 10% of the bid. All bidders shall, as bid security, accompany the bid with a bid bond in the amount of 10'© of the bid in lawful money of the United States, or a cashier's check, certified check, bank money order, or bank draft, in any case drawn and issued by a national banking association located in the State of Montana, or a bid bond or bonds executed by a surety corporation authorized to do business in the State of Mont- ana. Any such bank instrument or bond shall be payable directly to the City of Kalispell. If a contract is awarded, the bidder whose bid is accepted and who shall there- after refuse to enter into and execute the proposed contract, as stated in said covenant shall absolutely forfeit such monies or bank instruments to the City of Kalispell, and becomes immediately liable on said bid bond to said sum. The money, bank instrument or bid bond, as the case may be, shall be returned to those bidders whose bid is not accepted. No bid shall be withdrawn after opening of the bids without consent of the City Council for a period of forty-five (45) days after the scheduled time of receiving bids. The Contract Documents, including plans and specifications, are on file at the Office of the Director of Public Works, Kalispell, Montana, and at the office of Thomas, Dean & Hoskins, Inc., Engineers, 1200-Twenty Fifth Street South, Great Falls, Montana 59405, and 923 South Main Street, Kalispell, Mt. 59901. Copies of the documents may be obtained by paying to Thomas, Dean & Hoskins, Inc., $25.00 for one setand$12.50 for each additional set, all of which is refundable to responsive bidders. Only planholders submitting a bid to the Owner will receive a refund. Subcontractors and suppliers do not qualify for a refund. The successful bidder will be furnished free of charge, with all additional copies of the documents necessary for contract award and construction purposes. The successful bidder will be required to furnish a satisfactory performance bond and labor and material payment bond in the full amount of the contract. In general, the improvements on which bids are requested will require construction of the following: Storm Drain Pipe, in Place R.C. Pipe 12" 1427 L.F. 15" 6234 L.F. 1811 748 L.F. 21" 373 L.F. 241, 7o8 L.F. 30" 688 L.F. Storm Drain Manholes, in Place 4" Diameter 20 EA. 5" Diameter 5 EA. 6" Diameter 1 Ea. Pavement Replacement 5802 S.Y. .Any bidder wishing further, information may obtain same from the Director of Public Works, City Hall, Kalispell, Montana 59901. The City may accept the lowest responsible bid, but the Council reserves the right to reject any of all bids or to waive any technicality or informality and accep any bid which may be deemed best for the interests of the City of Kalispell.
