Resolution 3046 - Public Hearing - Long Term Care FacilityCouncil Member, Everit A. Sliter, introduced the following resol.uLion and moved its adoption: RESOLUTION NO. 304.6 RESOLUTION CALLING FOR A PUBLIC: HEARING ON A PROPOSED PROJECT UNDER 'TITLE 17, CHAPTER 41, REVISED CODES OF MONTANA 1947, AS AMENDED BE.IT RESOLVED by the City Council of the City ref Kalispell , Montana, as follows: 1. RecitnI s. This City is authorized by Title 11, Chapter 41, Revised Codes of Montana 1947, as amended (hereinafter, the Act), to acquire, whether by construction, purchase, devise, gift or lease, or any one or more of such methods; any land, any building or other improvement, and all real and personal properties deemed necessary. in connection therewith, whether or not now in existence, which shall be suitable for use for commercial, manufacturing or industrial enterprises, recreation or tourist,facilities, and hospitals, long- term care facilities or medical facilities. To defray the cost of acquiring and improving any such projecL,,the City is authorized -by the Act to issue its revenue bonds and sell such bonds at public or private sale in such manner and at such time as may be determined by this body to be most advantageous. Such bonds are to be secured by a pledge of the revenues to be derived by the from the project, and may be secured by a mortgage and by a pledge of the lease and by such other security devices as may be deemed advantageous. A proposal has been presented to this Counr.i.l that the C9_ , acting pursuant to and in accordance with the Act, acquire properties for a project suita'.n for use for a �long-term care facility defraying the cost of acquisition thereof, by the issuance of revenue ponds of the City _ in an amount presently estimated to be approximately $ 1,L00,000.00 Under the provisions of the Act, any bonds so issued by the City shall be limiLerl obl.i.g,ti.on of the City ; and the bonds and interest coupons shall not conntiLme nor give rise to a pecuniary liability of the ___ Ci.ty or a charge against its general credit or taxing powers. 2, Public Hearin�R. Chapter No. 304 of the Montana Session Laws of 1974, effective on July 1, 1974, requires that prior to the issuance of any bonds under the authority of the Act, this Council _ shall give notice and hold a public hearing on the proposed project. Pursuant to such authority, a public hearing on the proposed project is called and shall be held ony��4, 1976, at Cap „T o'clock p.M. at the Council. Williams --�x E. xaPP, 1"tYor option of the foregoing resolution was duly seconded , and upon vote being taken thereon, the following voted in favor thereof: Councilmen Williams, Schwartz, .Allen, O'Boyle, Sliter, Granmo and Olson and the following voted against the same; no one whereupon the resolution was declared duly passed and adopted, -3- Gene Hufford, D, A. Davidson, Inc., requested cooperation of the City of Kalispell to sell bonds for building a 55 bed addition to the present Immanual Lutheran Nursing Rome. The amount of the bond issue will be $1,2009000.00: The project comes under the Industrial Development Revenue Bonds program whereby the existing property plus the addition would be vested in the name of the City of Kalispell with no financial obligation on the part of the city. The money, bond proceedings, etc. will be ha..ndlez by a trustee bank. ids. Hufford requested YAyor Rapp and councilmen to pass a res- olution. setting a time and place for a public hearing on the issue. City will be re- imbursed for costs of the bond issue. RESOLUTION NO. 304'6 Councilman Sliter moved adoption of Resolution #304,16 a resolution calling for a public hearing on a proposed project under Title 11, Chapter 41, Revised Codes of Plants na.1947, as amended, said project being the bond sale of $1,200,000.00,for construction of an addition to the Immanual Lutheran Nursing Home. Seconded by Counci- man Williams. Roll call vote. All voted aye. Resolution adopted. City Attorney Donahue to complete resolution and see that the public hearing is ad- vei^tised in Daily Teter lake. Councilman Olson asked Mr. Hufford why an audit on our two present sewer bond oblig ations was necessary when the State of Montana had just completed their state audit. Xr. Hufford replied that bond sales are now regulated by the Security and Exchange Commission and they have their requirements. That some past bond issues have become defunct in certain cities and that they are takan"o e tra precautions.
