FROM: Jarod Nygren, Senior Planner SUBJECT: Glacier Town Center PUD — Request for Planned Unit Development, (PUD) Extension MEETING DATE: November 16, 2015 BACKGROUND: This is a request by Stillwater Corporation to extend the PUD approval of the Glacier Town Center PUD for one year. Glacier Town Center received PUD approval in February 2008, along with annexation of the property and Phase 1 of the Glacier Town Center preliminary plat. The preliminary plat associated with the development has lapsed, but the PUD zoning overlay remains in affect due to an extension given by council last November. The applicant is reevaluating the phasing plan and product types, in light of current market conditions. The applicant has indicated their intention to eventually develop the property and would like to maintain the PUD zoning overlay for a subsequent preliminary plat proposal. Section 27.19.020(10)(b) of the Kalispell Zoning Ordinance, requires that the developer request an extension of the PUD, on a yearly basis after expiration of the underlying preliminary plat. If the one year extension is granted, the PUD and associated conditions will remain in effect. The code states that the council may grant one or more such extensions. If the request is not granted, the property will revert to a PUD placeholder zoning. Glacier Town Center PUD zoning overlay includes the four zoning designations of R-3 (single-family residential), R-4 (two-family residential), B-1 (neighborhood business), and B-2 (general business). The PUD proposes to ultimately develop 282 single-family residential lots, 150 townhouse lots, 200 apartment/condominium units, approximately 1.8 million square feet of commercial/office space, and 72.3 acres of parks and open space. Glacier Town Center PUD encompasses 485.5 acres and extends from Highway 93 North to Whitefish Stage Road. The property is generally bounded by Glacier Memorial Gardens cemetery, the Stillwater River, West Reserve Drive, and Applied Materials along its southern boundary; Whitefish Stage Road on its eastern boundary; and a combination of privately -owned, incorporated and unincorporated land along its northern boundary. RECOMMENDATION: It is recommended that the City Council adopt the first reading of ordinance 1765 and grant a one-year extension to the Glacier Town Center PUD. FISCAL EFFECTS: Minor positive impacts until the actual PUD begins, then significant positive impacts. ALTERNATIVES: Deny the request. WHEREAS, the City Council of the City of Kalispell approved the Glacier Town Center Planned Unit Development Agreement on February 4, 2008; and WHEREAS, the City Council of the City of Kalispell approved a one-year extension to the Planned Unit Development on November 3, 2014; and WHEREAS, property owner Stillwater Corporation now desires an additional one-year extension to the Planned Unit Development due to economic conditions; and WHEREAS, it is in the best interests of the City of Kalispell that the Glacier Town Center Planned Unit Development Agreement be amended as set forth below. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION 1. That the Glacier Town Center Planned Unit Development shall be extended for a period of one year until February, 2017. SECTION 2. This Ordinance shall take effect from and after 30 days of its passage by the City Council. It is our intention to eventually develop the property. Although the Preliminary Plat Phase I is set to expire, we intend to file a new Preliminary Plat once our planning is complete. We are reevaluating the phasing and product types in the original plan based on current market conditions. Although our planning and market studies are not complete at this time, we continue to feel that the existing PUD Zoning Overlay remains appropriate for the project.
