Resolution 2982 - Subdivision - French SubRESOLUTION NO. 2982 A RESOLUTION TO ACCEPT AS A SUBDIVISION WITHIN THE CITY OF KALISPELL THE AREA COVERED BY FRENCH ADDITION NO. 56 AND AREAS PREVIOUSLY ANNEXED TO THE CITY OF KALISPELL AS PART OF EAST COULEE DRIVE, ADDITION, TO BE KNOWN AS "FRENCH SUBDIVISION"; AND ACCEPTING CASH IN LIEU OF PARK LAND DEDICATION WITHIN SAID SUBDIVISION; AND PROVIDING THAT COSTS OF INSTALLATION AND ACCEPTANCE OF WATER AND SEWER FACILITIES AND THAT COSTS OF PAVING AND CURBING ARE TO BE BORNE BY THE PROPERTY OWNERS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: SECTION 1. That the City does accept as a subdivision of the City of Kalispell and establish as "French Subdivision" all that area contained in French Addition No. 56 and those portions of areas previously annexed to the City of Kalispell as a part of East Coulee Drive Addition, and as is set forth in the plat thereof furnished to the City Council for filing and recording this date. All roads and rights -of -way included therein are hereby accepted as streets of the City. Said plat does meet the requirements of the comprehensive plan for the City of Kalispell as developed to date. SECTION 2. Said subdivision is accepted on the following terms and conditions: A. The property owners therein shall install water and sewer facilities in said subdivision at their own expense and same shall be in accord with plans and specifications thereof as furnished by the City Engineer upon request. Any water and sewer facilities so installed shall not connect with existing city systems until approved by the City Engineer. B. The property owners therein shall install curbs and pave the street therein (Lehi Lane) at their own expense and in accord with plans and specifications thereof as furnished by the City Engineer upon request. C. Until all curbing is installed and said street (Lehi Lane) is paved to city specifications, the city will not be responsible for any maintenance, care or oil sprinkling of said street except for the plowing of snow in accord with the city's regular snow plowing schedules. SECTION 3. That dedication of park land within the platted area of French Subdivision would be unsuitable, uneconomical and difficult to develop or maintain or is otherwise unsuitable for park and playground purposes, and it is hereby ordered by the City Council of the City of Kalispell, Flathead County, Montana that land dedicated for park purposes should be and is hereby waived and cash in lieu of park land will be accepted in accord with the provisions of Title 11, Chapter 38, R.C.M., 1947. The amount of cash so accepted shall be $842.14. SECTION 4. That all of said French Subdivision shall continue to be classified as a No. 1 Residential District of the City. SECTION 5. That upon the property owners furnishing to the City the aforesaid sum of $ and plats acceptable for filing by the Flathead County Clerk and Recorder, the City Clerk shall record same and upon such recording the aforesaid French Subdivision shall be established.
