Resolution 2826 - Annexation - Govt Lot 1
RESOLUTION NO. 2826 A RESOLUTION TO INCORPORATE INTO THE CITY OF KALISPELL, AS AN ADDITION, A TRACT OF LAND LYING AND BEING IN GOVERNMENT LOT ONE (1) OF SECTION SEVEN (7) TOWNSHIP TWENTY-EIGHT (28) NORTH, RANGE TWENTY-ONE (21) WEST., P. M. M., FLATHEAD COUNTY BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. That pursuant to the Petition of R. W. Wheeler for Circle K Corporation, filed with the City Council of the City of Kalispell on the 4th day of October, 1971, and the submission of said Council by said Petitioner of a plat reflecting the survey and designation of that territory adjoing and adjacent to the City of Kalispell, into streets and blocks as an addition thereto, and pursuant to Section #11-401, Revised Code of Montana, 1947, the Council and Mayor do hereby approve that said territory may become a part of the City of Kalispell and is more particularly described as follows: A tract, piece or parcel of land situated, lying and being in Government Lot One (1) of Section Seven (7), Township Twenty-eight (28) North, Range Twenty- one (21) West., P.M.M., Flathead County, Montana and more particularly described as follows to wit: Commencing at the NW corner of Section 7, T 28 N., R 21 W., P.M.M., Flathead County, Montana; thence southerly and along the westerly boundary line of Section 7, 121.00 feet to a nail in the pavement; thence easterly and being parallel with the northerly boundary line of Section 7, 30.00 feet to an iron pin which is the true point of beginning of the tract of land being described and the easterly R/W of Meridian Road; thence easterly and continuing along same line, 140.00 feet to a pin; thence southerly and being parallel with the westerly boundary line of Section 7, 125.00 feet to an iron pin; 'thence westerly and being parallel with the north boundary line of'' Section 7, 140.00 feet to an iron pin which is on the easterly R/w of Meridian road; thence northerly and along said Road R/W, 125.00 feet to thy+ place of beginning and containing 0.40 acres of land more or less Attached Exhibit A is hereby made a part of this Resolution. SECTION 2. That the City Council has found good cause for the reduction of land to be set aside in said Addition for park purposes to one twelfth (1/12) of the total area of said Addition; and, the Council further finds it to be to the best interest of the City to accept a cash donation in lieu of said land for park purposes and the City does hereby order that said amount shall be the sum of Two Hundred DOLLARS ($200.00), which sum shall be deposited in the park fund of the City to be used according to law. SECTION 3. That upon the proper filing of said plat in the office of the County Clerk and Recorder of Flathead County, Montana, said territory shall become a part of the City of Kalispell and shall be classified as a No. 5 Business esidence District of said City. .'ASSED AND APPROVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF KALISPELL,, MONTANA THIS h day of October, 1971.
