Resolution 2796 - Road Closure - Golf Course RoadRESOLUTION 140. 2796 A RESOLUTION FINDING THAT IT IS NOT TO THE DrTRI',1E'NT OF THE, PUBLIC !NTE,R1-,'ST THAT AN EXTENSION OF NORTH MAIN STREET, XNU�T�N AS THE GOLF COURSE ROAD, BE DISCONTINUED AND ORDERING THAT SAME BE VACATED AND CLOSED. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, 14ONTANA: WHEREAS, at a regular meeting of said Council on the 5th day of April, 1971, a petition, in writing, was presented to said Council by the XalisiDell Golf Association, requesting the discontinuance and vacation of the following described street within said city, to -wit: All that protion of the northerly extension of Main street, also known as the Golf Course Road, lying in the SEk, Section 6, Township 28 North, Range 21 West, M.P.M., Flathead County, Montana, more particularly described as follows: Commencing at the point of intersection,of the center line of the aforesaid road with the south boundary of section 6, thence northeasterly, northerly and northwesterly along said road to its intersection with the north boundary of the SW4SE3-4 of said Section 6, and being the present location of the city limits of Kalispell. WHEREAS, at said meeting, upon motion duly made, seconded and passed by said Council, the City of Kalispell, as the owner of all lots on said street, did join in said petition; the City Clerk was ordered to publish Notice that said petition would be acted upon at a special meeting of said Council to be held on the 19th day of April, 1971, as provided by Section 11-2802, R.C,M. ', 1947; and said Notice was duly -published, as required by law, at least one week prior to the date set for acting on said petition; and WHEREAS, on the 19th day of April, 1971, at said Special Council Meetinc � T, the Council decided to postpone further action on said potitior until this 28th day of April, 101 far the purpose of allowing inter- ested persons additional time to develop facts which should be brought before the Council in acting upon said petition; and WHEREAS, on this 28th day of April, 1971, the Council having duly met and convened and heard both proponents and opponents of said petition, some of the opponents being represented by counsel, NOW THEREFORE, the Council: 1. Finds, after due consideration of all facts and data presented to it orally and in writing, that it is not to the detriment ofthe .public interest that said'petition be granted and said street discon- tinued; 2. And the Council further finds, that it is to the best inter- est of the public that said petition be granted and that said street be discontinued and vacated; 3. And the Council hereby orders the above described street be discontinued and vacated forthwith as provided by law.
