Resolution 5741 - Planning FeesPlanning Department 201 V Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.kalispell.com/planning MEMORANDUM REPORT TO: Doug Russell, City Manager J\J1_ FROM: Tom Jentz, Director SUBJECT: Proposed changes to Kalispell Planning Fees MEETING DATE: November 2, 2015 BACKGROUND: From time to time staff reviews our planning fee schedule to determine if changes need to be made over time. The last time the fee schedule was updated was in 2007. We are suggesting two modifications to the schedule, one to address the re -submittal of preliminary plats that have expired and the second to round off sign permit fees. Each is discussed below: 1. Fee assignment to address preliminary plats that are resubmitted after they expire: Preliminary plats are approval by the council for an initial 3 year time frame as provided for in state law. The city then has the option of granting two two-year extensions to the life of a preliminary plat for a total of 7 years from the time of actual approval. The applicant can proceed to final plat any time during this process installing the required streets, sewer, water, drainage, etc. or they can allow the preliminary plat to simply lapse. We are beginning to come up on subdivisions that have weathered the past economic climate but not gone forward. We have now had requests to re -submit their projects for approval to again vest them for up to 7 more years. In so doing, the new preliminary plats would be subject to planning board hearing, council review and action and they would be conditioned according to our current design and construction standards and MFE approvals. However, the preliminary plat fee for a new application is $1,000 plus $125/lot. Staff would offer a reduced application fee for subdivisions that are being resubmitted where the lot configuration stays the same or where only slight modifications are involved. Current subdivision application fee - $1,000 plus $125/lot Proposed resubmitted application fee - $1,000 plus $10/lot that remains unchanged $125/lot for each lot that is redesigned 2. Round sign permit fees to the closest dollar: Sign permit fees are tied to a 1997 building permit schedule which breaks out the permit cost based on the value of the sign. The schedule uses fractions of a dollar. We are asking that the final permit fee be rounded to the nearest dollar for ease of administration. RECOMMENDATION: It is recommended that city council approve Resolution 5741, revising the Kalispell Planning Department fee schedule. FISCAL EFFECTS: Adoption of the codes, and fee schedules, will have positive fiscal impacts to the city as it will encourage developers to re -submit lapsed preliminary plats. ALTERNATIVES: Deny the request. ATTACHMENTS: Resolution 5741, Revising the Planning Department Fee Schedule RESOLUTION NO. 5741 A RESOLUTION AMENDING RESOLUTION NO. 5237 THEREBY REVISING THE CITY OF KALISPELL PLANNING OFFICE FEE SCHEDULE AND SETTING AN EFFECTIVE DATE. WHEREAS, the land use planning services provided by the Kalispell City Planning Office include, but are not limited to, plat reviews, applications for growth policy amendments, annexations, establishment and amendments to zoning, applications for conditional use permits, flood plain reviews and appeals; and WHEREAS, it is prudent and necessary from time to time to review and amend the fees charged to the public that utilizes the services of the Kalispell City Planning Office so that the costs and expenses of that office are equitably distributed; and WHEREAS, the fee schedule of the Kalispell City Planning Office, attached hereto as Exhibit "A", equitably assesses the various fees to cover its costs and expenses and is anticipated to provide the necessary revenues to fund the Kalispell City Planning Office for fiscal year 2015-2016. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. The Kalispell City Planning Office fee schedule, attached hereto and fully incorporated herein by this reference, shall be and is hereby established as the valid and enforceable fee schedule of the Kalispell City Planning Office for those services provided and to remain effective until later amended or repealed. SECTION 2. This Resolution shall become effective immediately upon passage by the City Council and approval by the Mayor.
