A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M., OCTOBER 19, 2015, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. Mayor Mark Johnson presided. Councilors Atkinson, Carlson, Graham, Guiffrida, Kluesner, Kuntz, Saverud, and Mayor Johnson were present. Councilor Gabriel was absent. Also present: City Manager Doug Russell, City Attorney Charles Harball, City Clerk Aimee Brunckhorst, Planning Director Tom Jentz, Public Works Director Susie Turner, and Chief of Police Roger Nasset. CALL TO ORDER ROLL CALL PLEDGE OF ALLEGIANCE A. AGENDA APPROVAL Phil Guiffrida moved to approve the agenda as presented. The motion was seconded by Sandy Carlson. The motion carried unanimously upon vote. B. CONSENT AGENDA APPROVAL All items listed on the Consent Agenda will be accepted by one motion. If a council member desires to discuss an item separately, the item can be removed from the Consent Agenda by motion. Kalispell City Council Minutes October 19, 2015 Page 1 1. Council Minutes - Regular Meeting - October 5, 2015 10-05-15 Draft Minutes 2. Ordinance 1761 Second Reading - Flood Plain Ordinance and Maps This Ordinance amends the flood plain ordinance and maps to comply with new rules and regulations from the Federal Emergency Management Agency (FEMA) applying to floodplains. Ordinance 1761 Flood Plain 3. Ordinance 1762 Second Reading - Repealing Doe Licensing This Ordinance repeals the City's dog licensing requirements. Ordinance 1762, Repealing Dog Licensing 4. Proclamation - Red Ribbon Week - October 23 to October 31 A Proclamation urging all citizens to join in Red Ribbon Week and all year long to protect our community from the dangers of alcohol, tobacco, and other drugs. Red Ribbon Week Proclamation Chad Graham moved to approve the consent agenda as submitted. The motion was seconded by Wayne Saverud. The motion carried unanimouslv upon vote. C. COMMITTEE REPORT None. D. PUBLIC COMMENT Persons wishing to address the council on any issue not on the agenda are asked to do so at this time. Kalispell City Council Minutes October 19, 2015 Page 2 Karlene Osorio Khor, Public Comment Ms. Osorio-Khor spoke about speed and other safety concerns on 3rd Avenue East, and 4th Avenue East. She also spoke regarding speeding concerns at 7th Street and 1 lth Avenue. Gordon Winks, Public Comment Mr. Winks spoke regarding flooding frustrations experienced at Bill's Super 8 during heavy rains, asking the city to solve this issue. Public Comment Closed Seeing no further public comment, Mayor Johnson closed public comment. E. REPORTS/RECOMMENDATIONS AND SUBSEQUENT COUNCIL ACTION Persons wishing to address the council on individual agenda items will be asked to do so following staff reports. Please see the last page of the agenda for Manner of Addressing the Council. Comments shall be limited to three minutes. 1. Resolution 5740 - Resolution of Intent and Call for Public Hearing - Water & Sewer Regulations and Rates This Resolution sets a public hearing for November 16 on the City's intent to amend water and sanitary sewer utility regulations. Resolution 5740 Call for Public Hearing City Manager Doug Russell provided a brief introduction on this item. Public Comment on this item. Mayor Johnson opened public comment. Seeing none, he closed public comment. Jim Atkinson moved to approve Resolution 5740, a Resolution of Intent to adopt certain amendments to the regulations of the City Water and Sanitary Sewer Utilities, including the amendment to change the billing cycles to monthly and calling for a public hearing. The motion was seconded by Sandy Carlson. The motion carried unanimously upon vote. 2. Interlocal Agreement with Whitefish for Building Officials City Manager Doug Russell provided a presentation on this item. Counselor Saverud continued questions for staff. Counselor Graham continued questions for staff. Public Comment Mayor Johnson opened public comment. Seeing none, he closed public comment. Jim Atkinson moved to approve authorize City Manager to sign the Interlocal Agreement between the cities of Kalispell and Whitefish. The motion was seconded by Tim Kluesner. Councilor Guiffrida provided discussion on the motion. The motion carried unanimously upon vote. 3. Board Appointments to the Tourism Business Improvement District (TBID) The TBID Board of Directors has requested confirmation of their appointments of Natam Patel and Laurie Schulz to replace two resigned members. Board A]2pts to TBID Public Comment Mayor Johnson opened public comment, seeing none, he closed public comment. Jim Atkinson moved to approve confirm the Board Appointments of Natam Patel and Laurie Schulz to the Tourism Business Improvement District. The motion was seconded by Wayne Saverud. The motion carried unanimously upon vote. F. MAYOR/COUNCIL/CITY MANAGER'S REPORTS (No Action) City Manager Doug Russell provided the following report: • South Kalispell Urban Renewal Plan should be released shortly and a work session scheduled possibly in November. Kalispell City Council Minutes October 19, 2015 Page 4 • Next Work Session: Local Legislators have been invited to a forum. Several have responded that they will attend. This work session will also include a review of fire and police impact fees, and review Old School Station appraisals and marketing. Councilor Atkinson spoke regarding the League of Cities and Towns Conference saying it was a good conference and went well. At the conclusion, Kalispell received an award from Tree City USA. The city had applied for this, showing Tree City USA that we are utilizing the wood from the Dutch Elm trees to give to the High School to make beautiful projects. Councilor Atkinson asked that the public comment about Bill's Super 8 be followed up on. Councilor Graham spoke regarding the algae blooms that had been pulled off the pond at Woodland Park, thanking the Parks Department for their work on that. Councilor Kuntz confirmed that exhibit P, stating contractors in a residential area are exempt from needing a permit was included in Ordinance 1759, regarding Parking. Mayor Johnson read the Mayoral Proclamation that was passed on the consent agenda tonight declaring October 23 to October 31 Red Ribbon Week. Mayor Johnson spoke regarding the following: • He agreed with Karlene Osorio-Khor's public comment from this evening that there are sometimes speeding issues on 3rd and 4th. • He spent time with representative Zinke yesterday tallying about issues on the Federal level that impact the city and vice versa. • Mayor Johnson had the honor of attending an event hosted by Rebecca Farms today where they presented money they raised for cancer research and treatment contributing over $71,000 to various organizations.
