Resolution 2430 - Resolution of Intent - SID 298RESOLUTION NO. 2430 RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT NO, 298 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1, That it is the intention of the City Council of the City of Kalispell, Montana, to create Special Improvement District No. 293 6 r the purpose of constructing a storm drainage system in the main business district in the City of Kalispell, Montana, together with an outflow line running South to Ashley Creek. SECTION 2. That the boundaries of the area to be included within this Special Improvement District are described as follows: Beginning at a point on the south line of Center Street and Second Alley West of Main Street, thence Easterly along North line of Center Street to Second Alley East, thence Southerly along Second Alley East to South line of Fifth Street East, thence Westerly along South line of Fifth Street East to First Alley East, thence Southerly along First Alley East to South line of Lot twenty-two of Block Eighty-five of Original Townsite of Kalispell, Montana, thence Westerly along South line of said Lot twenty-two crossing Main Street and continuing Westerly along South line of Lot Three of Block Eighty-six of the ONginal Townsite of Kalispell, Montana, to First Alley West, thence Northerly along First Alley West to South line of Fifth Street West, thence Westerly along South line of Fifth Street West to Second Alley West, thence Northerly along Second Alley West to Center Street, the point of beginning, all of which area is contained within the City limits of the City of Kalispell, Montana. SECTION 3. That the general character of the improvement to be made in said Special Improvement District is the construction of a storm sewer drainage system in the business district with outflow line to Ashley Creek. Section, 4. That the estimated cost of such Improvement is $270,000.00. SECTION 5. That the entire cost and expense of such improvement shall be assessed against each lot or tract of land within the, district to be assessed forthat part of the whole cost which its area bears to the area of the entire district. SECTION 6. That said assessment shall be paid for in full upon completion of the contract, or shall be paid for in ten equal installments hereby extended over a period of ten years. Said assessments shall constitute a fund to be known as Special Improvement District Fund No. 293. SECTION 7. That said Improvement shall be paid for in Special Improvement District Bonds issued against said District In sums not to exceed $5,000.00 each' bearing interest at a rate not to exceed Six (6%) per cent per annum, from date of registration until called for redemption or paid in full. SECTION 8. That all lots contained within said Special Improvement District, owned by the United States of America, namely: Lots 70 8, 99 10, 11, and 12 of Block Fifty-seven ' of the Original Townsite of Kalispell, Montana, shall be omitted from the assessment thereafter to be made to cover the cost of said improvement, and the cost for said improvement for said lots shall be paid by the City of Kalispell, Montana, from its general fund. SECTION 9. That on the 6th day of March, 1961, in the Council Chambers of the City Hall in the City of Kalispell, Montana, at 7:30 P. M., at a regular meeting, the City Council will hear and pass on any protests that may be Me against the making of said Improvement of the creation of said district. SECTION 10. The City Clerk is hereby authorized and Instructed to give the proper notice of the passage of this resolution by publication and mailing as required by law. Such publication is to be made in The Daily later Lake, a daily newspaper, published in the City of Kalispell, Montana.
