Resolution 2379 - Improvements to Water & Sewer SystemsRESOLUTION NO. 2379 WREREAS, it is deemed advisable by the Mayor and Council of the City of Kalispell, Montana, that said City shall, make certain improvements to the water and sewer systems of said City, NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Kalispell, Montana, as follows: 1. This Council does hereby find and determine and declare that It is essential to the health, safety and welfare of the City and its inhabitants for said City to establish, build and construct additions and betteinnents to the water and sewer systems, which will be considered as a single undertaking, said undertaking being paid for by the issuance of Revenue Bonds in conformity with the Municipal Revenue Bond Act of 1939. 2. That subject to the approval by the qualified electors of the City of Kalispell, Montana, of the Proposition hereinafter described, at a spec ial. election hereinafter ordered authorizing the issuance of $250,000.00 in Revenue Bonds, the followiag undertaking shall be done: (1) The Installation of covers on two water reservoirs; (2) Construction of a storage warehouse and shop building; (3) Making additions and betterments to the sewage treatment plant, which upon such construction and Installation shall be owned, operated and controlled by the City of Kalispell, Montana. The construction of the foregoing is in accordance with the preliminary maps, ,-plans, and specifications as prepared by Morrison4Maierle, Inc., Engineers of Helena, Montana, Brinilman and Lenon, Architects of Kalispell, Montana, and Lloyd 3. McClintick, Engineer for the City of Kalispell, Montana, for the carry- ing out of the plan of, coustruction, complete details of which said project are fully set forth and specified in the above maps, plans, and specifications, which said maps, plans, and specifications have been filed, and are new on file, in the office of the Clerk of the City of Kalispell, Montana, which said maps, plans, and specifications are hereby expressly adopted and approved. 3. The total cost of doing all the foregoing, together with all necessary costs and engineering expenses, legal costs, labor costs and incidental costs, as estimated by the Mayor avid Council will be $250,000.00, which will be raised by the issuance of Revenue Bonds. The foregoing estimated cost also includes inspect- ion and fiscal expenses. camrAq� &MM 4. That a special election of the qualified electors of the City of Kalispell, Flathead County, Montana, shall be, and Is hereby ordered to be held in said City on Montlayt APRIL 6, 1959, between the hours of 8:00 otclock A. M. and 3:00 otclock P. M., on said date, at which election the question of the construction, improve- ment and betterment to the Water and Sever Systems, and the subsequent ownership, maintenance and operation by said City, and the payment of the cost of the same by the issuance of Revenue Bonds in the amount of $250,000.00, shall be suNaitted to the qualified registered voters of said City and to their assent or rejection, as provided by law. A qualified registered voter of the city is one whose name appears on the last preceding assessnent roll for state and county taxes, as taxpayers upow property within the City. The said Special Election will be held at the following places: FAME OF VOTING PLACE LOCATION OF VOTING -PLACE Coca-Cola Bottling Company Ward One 451 N. Main St. 1. 0. 0. F. Temple Ward 'Two 347 First Ave. East Ridley Motors Ward Three 416 First Ave. East Flathead County Court House Ward Four Main anti Eighth Streets Such voting place, or places, and the ballot boxes for said special election will be opened at the hour of 8:00 o'clock A. M., and will continue open until, and will be closed at, the hour of 000 O'clock, P. M. on said day. The voting at said election shall be by ballot, and the Proposition which shall be submitted thereon at said election, shall be substantially in the following alternative for, viz. .... FOR the issuance of Revenue Bonds to the extent of $250,000.00 for I . the construction of improvements, additions and betterments to the .... Water. and Sewer Systems as provided in a Resolution of the Council adopted February 2, 1959. Said bonds will be dated May 1, 1959, and will mature from 1960 to 1969, inclusive, and will bear interest at a rate, or rates, of not in excess of five per cent (5%) per annum. AGATNST the Issuance of Revenue Bonds to the extent of $250,000.00 for the construction of improvements, additions and betterments to .... the UhLer and Sewer. Systems as provided In a Resolution of the Council adopted February 2, 1959, Said bonds will be dated May 1, 1959, and will mature from 1960 to 1969, inclusive, and will bear interest at a rate, or rates, of not in excesKof five per cent (50 per annum. if at such election a majority of the electors qualified and entitled to Wte at said election, and voting at such election, assent to the construction, of improvements, additions and betterments to the Nater and Sewer Systems, and the payment thereof solely out of and from the earnings and revenuts of said Water and Sewer Systems, such bonds for said purpose shall be issued as provided by the Bond Law of the State Of Montana. 5. NOTICE OF SAID ELECTION shall be posted in each precinct at least Len (10) days before the date of election and shlI be published in the Daily Inter lake, a legal novspaper, printed and published daily except Saturday at Kalispell, Montana, and being the official nevzpaper of said City; that said publication shall be had once a week for two successive weeks prior to such election, said publications to be on March 27th and April 3rd, 1959, prior to the date fixed for said election, which said Notice of Election shall set forth the purpose of this Resolution, the amount of bonds authorized by it, and the maturity date of said bonds, and the maximum rate of interest which said bonds shall bear, the. voting place, or places, the hours between which the polls shall be open, the qualifications of the voters who may vote thereat, and shfl.1. refer to this Resolution for further details and particulars; and shall be given in the name of the City of Kalispell, Montana, by the Mayor and City Council and attested by the Clerk thereof. 6. Upon the adoption of the Resolution calling for the election the City Clerk shall notify the County Clerk of the Date on ubich the election is to be held and the County Clark must cause to be published in The Daily Inter Lake, an official newspaper of the City, a Notice signed by the County Clerk stating that registration. 547 interest; and that any future charge which may be created by said City, or aMhor- Ized by the qualified electors and made payable out of the revenues of said systems, shall constitute a charge and lien subject to the charge and lien thereon and to the duty of the City of Kalispell with respect to said revenues, =epting therefrom the issuance of parti.y bonds, which will be authorimd by subs"umt resolution. 10. That the said Notice of Special Electiop shall be in substantially the follow- ing form, which Notice of Special Election is hereby adopted and approved by this Council, Viz: NOTICE OF SPI,:CTAI, MUNICIPAL BOND ELECTION AND QUALIFICATION OF VOTERS NOTICE IS HEREBY GIVEN that pursuant to a Resolution passed and adopted at a regular meeting of the City Council of Kalispell, Montana, on February 2, 1959, a special bond election, will be held in said City on April 6, 1959, between the hours of 8:00 o'clock A. M. and 3:00 oOclock P. M. for the purpose of voting upon the question and Proposition of issuing revenue bonds inthn, amount of $250,000.00 for the following purposes; (1) The construction Of covers on two water reservoirs; (2) Construction of a storage warehouse and shop building; (3) Making additions and betterments to the sewage treatment plant pursuant to the provisions of the foregoing Resolution, which Resolution is hereby referred to for furtber particulars, and which is made by reference as part of this Notice. said construction, Improvement and betterments to said systems are In accordance with the maps, plans, and specifications of Morrison-Maierle, Iac.V Engineers of Helena, Montana, Brinkamm and Lenora, Architects of Kalispell, Montana, and Lloyd B. KcClintick, Engineer for said City, and said nmps, plans, and speci- fications are now on file in the office of the City Clerk of said City and have been expressly adopted and approved by said Council. Said bonds shall be dated May 1, 1959, or on the first day of any succeeding month; as may be determined by the Mayor and Council and the purchaser subsequent to the sale thereof, shall bear interest at a rate, or rates, of not in excess of five per cent (5%) per annan, payable semi-annually, shall be of the denomination of $1,000.00 each, shall be payable solely out of and from the revenues of said Water and Sewer Systems, and shall mature from 1960 to 1969, inclusive on an amortized basis. The question to be submitted to the qualified electors shall be by ballot reading substantially as follows: .... FOR the issuance of Revenue Bonds to the extent of $250,000,00 for the construction of improvements, additions and betterments to the Water and Sewer Systems as provided in a Resolution of the Council adopted February 2, 1959. Said bonds will be dated May 1, 1959, and will mature from 1960 to 1969, inclusive, and will bear Interest at a rate, or rates, of not in excess of five per cent (5%) per annum. .... AGAINST the issuance of Revenue Bonds to the extent. of $250,OOQ.00 for the construction of improvements, additions and betternents to the Water aad Sewer Systems as provided in a Resolution of the Council adopted February 2, 1959. Said bonds will be dated May 1, 1959, and will mature from 1960 to 1969, inclusive, and will bear interest at a rate, or rates, of not in excess of five per vent (57) per annual.
