Resolution 2376 - Election - Issue Sewage Revenue Bondsan RESOLUTION NO. 2376 A RESOLUTION FOR THE SUBMISSION TO TnE QIUALIFIED ELECIURS OF THE CITY OF KALISPELL, MONTANA, AT TUS GENERAL MUNICIPAL ELECTION TO BE HELD APRIL 6, 1959, THE q`UESTTaN OF ISSUING SEWE REVENUE BONDS IN THE AMOUNT OF $147,000.00 FOR TnE REPAIR, IMPROVEMENT, AND RECONSTRUCTION OF THE SEWAGE PLANT OF THE CITY OF KALISPELL, MONTANA. 1. WHEREAS the municipal owned sewage disposal plant of the City of Kalispell is in need of repair, improvement, and reconstruction in order to makc it service- able to the increasing needs of the City of Kalispell and its inhabitants, and it is deemed necessary and advisable by the City Council of said City that Revenue Sewage Bonds In the amount of $147,000.00, being the estimated cost of such improvements and repair, be issued by the City of Kalispell, Montana, under the provisions of the laws of the State of Montana of 1951 as amended by Chapter 146, such bonds to be either serial or amortization bonds bearing interest not to exceed 6% per annum payable semi-annually maturing in ten years from date of issue; said bonds to be revenue bonds only, the principal and interest thereof to be paid and retired from and out of the rates, rentals or charges for the use of the facilities, services and benefits rendered by or in connection with the municipal sewage disposal plant and sewage System of the City of Kalispell as such rates, rentals charges or assessments are new or may be hereafter fixed and approved by Ordinance of the City of Kalispell, all as provided by said act of the legislative Assembly of the State of Montana as amended. 2. AND UNEREAS, a general municipal election of the City of Kalispell, Montana is scheduled as provided by law to be held on Monday, April 6, 1959, between the hours of 8:00 A. M,. and 6:00 P. M., of said day, and it is denned and judged by the City Council of the City of Kalispell, Montana, advisable and feasable that the question of the issuance of Sewer Revenue Bonds as above mentioned be sub- mitted to the qualified electors of the City of Kalispell, Montana, as the term qualified electors is used and intended by said act and amendments thereto, at said municipal election so to be held on the date aforesaid. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: That there be submitted to the qualified electors of the City of Kalispell, Montana, within the meaning of the above mentioned Act, as amended, the question of Lho issuance of Sewer Revenue Bonds by the City of Kalispell, Montana, In the amount of $147,000.00 for the purpose of repair, improvement, and reconstruction of the sewage disposal plant of the City of Kalispell, Montana, such bonds to be either serial 543 or gmortjzatian bonds maturing within ten years from date thereof and bearing interest at not to exceed 6% per annum, such bonds to be paid and retired fran income and revenue to be derived frow and out of the rates, rentals, or charges for W use of the facilities, services, and benefits rendered by or In connection with the municipal sewage disposal plant and sewerage system of the City of Kalispell, as such rates, rentals charges or assesmnents are not or may hereafter be fixed and approved by Ordinance of the City of Kalispell, all as provided by Act of the Legislative Assembly of the State of Montana, as amended, and the City Clerk is hereby authorized and directed to give the necessary notices of such election and of the submission of such question to the qualified electors of the City of Kalispell, and to prepare the necessary ballots therefor, and to do all other acts and things necessary for the accomplishment of the purposes of this resolution.
