Resolution 2375 - Election - Issue Water Revenue BondsRESOLUTION NO. 2375 A RESOLUTION CALLING FOR AN ELECTION 10 BE HELD AT THE GENERAL MUNICIPAL ELECTION ON APRIL 6, 1959, TO SUBMIT TO WE QUALIFIED VOTERS OF THE CITY OF KALISPELL, MONTANA, THE QUESTION' OF ISSUING REVENUE BONDS OF THE MUNICIPAL WATER DEPARTMENT FOR IMPROVEMENTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONT'ANA: 1. The City Council does hereby find, determine and declare; that it is essential. to the health, safety and welfare of the City of Kalispell, and its Inhabitants, that protective covers be installed on the City0s two water storage reservoirs, as required by the State Board of llealth; that additional, funds be provided to continue the replacement of obsolete distribution mains and for the construction of a new storage warehouse and shop for the municipal water department; that the estimated cost of these improvements is $100,000.00 to be paid for by the Issugnee and sale of Revenue Bonds In conformity with the Session Laws of Montana of 1951, Chapter 14.5; that the income and revenues from the operation of the Municipal Water Department are sufficient to pay and discharge all costs of operation, repalrs, and maintenance of said system, plus reasonable depreciation reserve, and sinking funds sufficient to meet all payments of principal and interest on the Revenue Bonds which may be so authorized, Issued and sold, as such principal and interest become due during the period of years through which such bonds are to be paid, as therein specified; that such bonds, if authorized, issued and sold, shall be payable as to both. principal, and interest solely from, and shall be a valid claim of the holders thereof only against the sinking fund and the net incamc and revenues of the Municipal Water Department pledged thereto, and shall not constitute an indebtedness of the City of Kalispell, Montana within the meaning of any charter, statutory, or constitutional Ilmitation upon the incurr- ing of indebtedness, nor shall the City of Kalispell incur in respect thereto, any obligation for the payment of which taxes ' may be levied; that the proposal to issue such ROvenue Bonds and use the proceeds thereof for such purposes should be submitted to the qualified taxpayer voters of the City of Kalispell, Montana; and that such qualified taxpayer voters include all, but only, the duty registered electors of the City of Kalispell, Montana, whose names appear upon the last completed assessment roll for State and County taxes as taxpayers upon property within the City of Kalispell, Montana, 2. An election is hereby called and directed to be held at the General Municipal election to be held Monday, April 6th, 1959, for the purpose of voting on the question stated in the form of ballot hereinafter prescribed, 3. At said election all, but only, the duty registered and qualified electors of the City of Kalispell, Montna4, whose names appear upon the last proceeding assessment roll for State and County taxes as taxpayers upon property within the City of Kalispell, Mantana, shall be entitled to vote. The City Clerk is hereby authorized and directed to give notice forthwith to the County Clerk of Flathead County, Montana of the call of said election. The County Clerk shall, after giving due notice of the closing of the registration books, prepare and post printed lists of the registered voters entitled to vote at said election, and shall prepare poll books for such election for each precinct of the City In the form and manner required by law. The City Clerk is hereby authorized and directed to give notice of the call and holding of said election by publication, once each week for not less than two consecutive weeks in a newspaper published In Kalispell, Montana, the last such publication to be on the last day on which such newspaper is published before the day of election, and by causing notice to be posted in at least five of the most public places In each voting -precinct in the City at least ten days prior to the date of said election, which notice so published and posted shall read sub- stantially as follows; NOTICE OF ELECTION CITY OF KALISPELL, MONTANA NOTICE IS HEREBY GREEN, that on Monday, April 6th, 1959, an election will be held in and for the City of Kalispell, Montana, for the determination of the question whether said City shall issue and sell its negotiable Revenue Bonds in the amount of $100,000.00 to be payable for a term of ten. years from their date of issue, and use the proceeds thereof to finance the cost of constructing pro- tective covers for the two water storage reservoirs of the City®s Municipal Water Department, replace obsolete distribution mains, and construct a new storage warehouse and shop, all in conformity with Session Laws of Montana of 1951, Chapter 145, such bonds and the interest thereon to be payable solely from the net income and revenues of the Municipal Water Department, and not to incur any obligation, for the payment of which taxes may be levied, except to pay for services provided by the undertaking to the City itself. Further details of said matter are set forth in the Resolution No. 2375 duly passed by the City Council. and now on file In the Office of the City Clerk. M. and 6:00 o'clock P. M. on, said day of election. All, but only, the duly registered and qualified electors of the City of Kalispell, Montana, whose names appear upon the last preceeding assessment roll for State and County Taxes as taxpayers upon property within the City of Kalispell, Montana, are entitled to vote at said election. Dated at Kalispell, Montana, this 19Lh day of January, 1959, BY ORDER OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA CITY CLERK The City Clerk shall cause suitable ballots to be prepared for use at said election, and shall distribute the same to the judges of election In the respective precincts, together with the poll books supplied by the County Clerk, and other necessary and proper election supplies, which ballots shall read substantially as follows: OFFICIAL BALLOT CITY OF KALISPELL ELECTION APRIL 6, 1959 (MARK) a cross (X) in the square opposite the word FOR if you wish to vote in favor Of the following Proposition, Or in the square opposite the word AGAINST if you wish to vote against said, proposition. FOR the City of Kalispell, Montana, issuing anti selling its negotiable revenue bonds in the amount of q],00,000.00 to be payable during a ten year period from date of their issue, and using the procceds thereof to finance the building of covers for the City"s two water Storage reservoirs, to provide funds for the continued replacement of obsolete mains, and to construct a new warehouse and shop for the Water Works Department, all in conformity with the Sessioa Laws of Montana of 1951, Chapter 145, such bonds and the Interest thereon to be payable solely out of net income and revenues to be derived rates and charges for the use of vie facillties provided by the undertaking and not to incur any obligation for Lhe paymLnt of whic-h taxes may be levied except to pay for services provided by the undertaking to the City itself. The City Clerk is authorized and directed to furnish to the judges and clerks of election all other necessary and convenient facilities and supplies for said election and the returns thereof. Said electiom shall in all respects be held and conducted in accordance with the general laws applicable to such elections.
