LEGAL DESCRIPTION OF PROPERTY:
Lot 2 of Meridian Complex East No. 2, as shown on the map or plat thereof
on file and of record in the office of the county Clerk and Recorder of
Flathead County, Montana.
The Applicant has applied to the City of Kalispell for an administrative conditional use permit for
the construction of a new mini -storage units which will replace an existing shed on the property. The
permit is required due to its location in the R-3 (Residential) zone. The matter was reviewed by the
City of Kalispell Zoning Administrator and the City of Kalispell Site Development Review
Committee and, after duly considering the application, grants the administrative conditional use
permit subject to the following conditions:
(1) The property shall be developed in accordance with the revised submitted plans.
(2) The amended plat reflecting the boundary line adjustment shall be finalized and
recorded prior to this permit becoming effective.
(3) An additional fire hydrant shall be installed at a location to be determined in
coordination with the Kalispell Fire Department.
(4) Improvements in the adjacent right-of-way shall be installed according to
Kalispell Public Works specifications. Improvements shall include, but are not
necessarily limited to, sidewalk, landscape boulevard, and, if necessary,
curb/gutter and street lighting. All improvements shall be reviewed and approved
by Public Works.
(5) Development of the site will require additional review by the Site Development
Review Committee and the Architectural Review Committee prior to issuance of
a building permit. Such review shall include, but is not necessarily limited to,
storm drainage and aesthetic considerations.
(6) A floodplain development permit is required prior to commencement of any
development of the property.
(7) Any lighting shall be fully -shielded and meet the requirements for outdoor
lighting contained in the Kalispell Zoning Ordinance.
(8) Fencing shall be limited to 4 feet in height in the front setback area and 72 inches
in height in side and rear setbacks. Use of barbed wire, razor wire, electric
fencing, or similar types of fencing is prohibited.
(9) A landscape buffer shall be installed along the west property boundary adjacent to
the right -of way and along the south property boundary. Landscaping shall
consist of a variety of hardy evergreen materials consisting of trees, low-,
medium-, and high -profile shrubs, together with suitable ground cover such as
native grasses, bark, ornamental gravel, or a combination thereof. Landscaping is
subject to review and approval by the Kalispell Parks Department under the
landscape ordinance, the Site Development Review Committee, and the
Architectural Review Committee.
(10) Building heights shall be limited to one story (18 feet at the peak).
(11) Parking/driving lanes adjacent to the units shall be paved and be at least 26 feet
wide. Where no units are accessed from the driving lane, standard two-way
driving lane dimensions shall apply.
(12) The exterior architecture of the structures shall be designed to conceal the
industrial and storage use of the property. The design shall also focus on
neighborhood compatibility.
(13) All storage shall be kept within an enclosed building, except fossil fuel engines or
storage tanks or any boat or vehicle incorporating such components, which shall
be stored in screened exterior areas. This provision shall not be interpreted to
permit the storage of partially dismantled, wrecked, or inoperable vehicles.
(14) Any use other than storage is prohibited. The offering for sale or sale thereof of
any item from or at the property is expressly forbidden, except that the facility
owner may hold liquidation sales of contents of rental units to recover rental fees
as allowed by law.
(15) The repair, construction, or reconstruction of any boat, engine, motor vehicle, or
furniture, and the storage of any fossil fuel engine or fossil fuel storage tank or
any boat or vehicle incorporating such components is prohibited within any
structure on the property.
(16) This permit shall be valid for a period of eighteen (18) months after which time it
shall terminate if commencement of the authorized activity has not begun.
