Resolution 2372 - Resolution of Intent - SID 296537 RESOLUTION NO. 2372 RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRTCT NO. 296 BE IT RESOLVED BY TEE CITY COUNCIL OF THE CITY OF KALISPELL, C,110NTANIA' SECTION 1. That it is the intention of the city Cmn&l of the City of Xanspel I, Montana, to create Special Improvement District No. 296 for the purpose of installing new water mains consisting of approximately 3487 feet of eight inch and 2461 Poet of six inch mains together with the necessary hydrants and appurten- ances in Underhill Subdivision and Adams Addition to Kalispell, Montana. SECTION 2. That the boundaries of the area to be inel"ded within this Speciel Improvement District are described as follows' UNDERE111 SUBDIVISION Beginning at the Southwest corner of Lot 1, Section 7, Township 28 North, Range 21 West, said point being 1313.6 feet Southerly from the Northwest corner of Section 7; thence N. 89' 52' 45'' E., a distance of 30.82 feet to a point on the Easterly boundary of Meridian Ron, theme N. 00 30 1, 60 feet to the true point of beginniag; thence N. 89- 521 45- Z., 695.2 feet; thence S. 00 330 E., 60 feet to as point on the Southerly boundary of said Lot 1; thence N. 890 521 45" E., 381.12 feet to the established Southeast corner of said Lot 1; thence N. 00 041 E., 300 feet; thence S. 89' 520 4511 W,, 384,3 feet*, thence N. 00 331 W., 63 feet; thence S. 890 521 45" W., 695.07 feet to a point on the East- erly boundary of Meridian Road; thence S. 00 321 W., 303 feet to the point of beginning. ADAMS ADDITION All and singular that certain tract or parcel or piece of land situate, lying and being in the NEkNEJ of Section 12, Township 28 North, Range 22 West of the M, P, m. and being more particularly described as follows: Beginning at the Northeast corner of the aforesaid Section 12; thence S. 00 431 E. 1066�73 feet aloup, the Easterly line of aforesaid Section 12, to a point, which point is N. 00 431 W. 255 feet from the Southeast corner of aforesaid NE:4NEI,, thence S. 890 151 W. 29.12 feet to the Westerly right of way of Meridian Road, as constrwtoh, to a point, which point Is the true point of beginning of this subdivision, thence S. 890 451 W. 1244,60 feet to a point; thence N. 00 011 E. 1030.35 feet to a point on the Southerly right of way of Three Mile Drive; thence N, 890 32' E. 853.33 feet to a point; thence along a 150 061 Curve to the right of a 379.3 foot radius for a length of 594.26 feet to the point of termination; thence S. 00 421 E. 657.43 feet, along the Westerly right of may of Meridian Road, to the point of beginning. SECTION 3. That the general character of the improvements to be made in said proposed special improvaiant district is the installation of water neins and the necessary appurtenances. SECTION 4. That the estimated cost of such improvements, is $414,000.00. SECTION 5. That the entire cost and expense of such improvements shall be assessed against each lot within the district to be assessed for that part of the whole cost which its area bears to the area of the entire district, SECTION 6. That said assessment shall be paid for in full upon completion of the contract, or shall be paid in ten equal annual installments horeby extended over a period of ten years. Said assessments shall constitute a fund to be known as Special Improvement District Fund No. 296. SECTION 7. That said improvements shall be paid for in Special Improvement District Warrants issued against said District in sues not to excea Q^040 each, bearing interest at a rate not to exceed 6% per annum, from date of registration until called for redemption or paid in full. SECTION 8. That on the Ist day of December, 1958, in the Council Chambers in the City Hall in the City of Kalispell, Montana, at 7:30 PM., at a regular weet.ing, the City Council will hear and pass on any protests that may be made against the making of said improvements or the creation of said District. SECTIOV 9. The City Clerk is hereby authorized and directed to give the proper notice of the passage of this resolution by publication and mailing as required by law. Such publication Is to he made In the Kalispell News -Farm Journal, a weekly newspaper, published in the City of Kalispell, Montana.
