SUBJECT: Resolution setting a public hearing for a budget amendment for the
acceptance of $10,976.24 of Homeland Security forfeiture funds.
MEETING DATE: December 15, 2014
BACKGROUND: Beginning in 2004, the Kalispell Police Department assisted the
Northwest Drug Taskforce and federal law enforcement agencies in a multi -year
international drug case, which resulted in the seizure of 1070 pounds of marijuana,
multiple arrests, and drug related property forfeiture. In 2009, the Kalispell Police
Department applied for "federal asset sharing" funds for our contribution to this
investigation. On December 6, 2013, we received a federal asset sharing check in the
amount of $10,976.02 from the U.S. Department of Homeland Security.
These funds were receipted into the "Drug Enforcement Grant Fund" to be applied
toward expenditures in FY2015. Going back and reviewing the 2009 application
requirements, these funds will need to be transferred into another fund and used toward
equipment expenditures. In order to accomplish this, we need to perform a budget
amendment to authorize the increase in expenditures for the fund. Funds will then be
transferred out of the Drug Enforcement Grant fund. Shortfalls in this fund because of
the transfer will be made up with a transfer from our Contingency Fund, which currently
has a $30,000 balance.
As we are currently in the process of converting our in -car camera systems to the
Watchguard system, we are requesting that the forfeiture funds be appropriated toward
the acquisition of these cameras. We currently have 6 of our 9 patrol vehicles set to have
the Watchguard system installed. This would add two additional units, with the last unit
to be replaced next year with the next patrol car acquisition.
As part of the budget amendment process, we need to conduct a public hearing. The
resolution before the council sets the date of the public hearing for January 5, 2015.

RECOMMENDATION: It is recommended that the Council adopt resolution 5698,
setting a public hearing on the consideration of a budget amendment which transfers
$10,976.02 from the Drug Enforcement Grant fund to the Law Enforcement fund, and to
authorize the use of the funds to go toward in -car camera systems.
FISCAL EFFECTS: No local match required.
ALTERNATIVES: Decline forfeiture money.

A RESOLUTION CALLING FOR A PUBLIC HEARING- TO AMEND THE ANNUAL
APPROPRIATIONS OF THE CITY OF .KALISPELL, MONTANA, AS SET FORTH IN THE 2014-
2015 BUDGET ADOPTED BY THE CITY COUNCIL.
WHEREAS, certain drug forfeiture funds received and recorded into a federal grant fund in the budget
adopted by the City of Kalispell for the 2014-2015 fiscal year may be legitimately moved to a
less restrictive law enforcement fund allowing for the purchase of needed "In car" camera
systems.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION I. On the 5th day of January, 2015 at 7:00 o'clock P.M., in the Council Chambers, City
Hall, 201 1 st Avenue East, Kalispell, Montana, the City Council of the City of
Kalispell shall hold a Public Hearing on the following amendment to the 2014-2015
fiscal budget:
REVENUE To move forfeiture monies into
2919-000-383001-000 $101976.02 appropriate fund
EXPENDITURE To receive the forfeiture monies as the
2916-413-420140-820 $101976.02 appropriate fund (2919)
REVENUE To increase FY 14 revenue to balance

EXPENDITURE To increase budget to allow expenditure
2919-413-420140-941 $10,976.02 of forfeiture funds
To allow for the purchase of "In car" camera systems.
SECTION II. That notice of the passage of this resolution shall be published pursuant to Section 7-
1-41271 MCA.
