Resolution 2285 - Resolution of Intent - SID 290RESOLUTION NO. 2285 RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEPENT DISTRICT No. 290 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA SECTION 1. THAT IT IS the intention of the City Council of the City of Kalispell, Montana, to create Special. Improvement District No. 290 for the purpose of participating with the State Highway Commission and the Bureau of Public Roads for the widening and rebuilding of Idaho Street with the City Limits of Kalispell, and the rebuilding of North Main Street along the present right of way of U. S. Highway 93 from Idaho Street 'to Wyoming Street, according to the plans and specifications of Projects No. F 270 (7) and U 257 (14) of the Montana Highway Commission. SECTION 2. That the area to be included within said Special Improvement District shall be as follows; All lots, blocks, and unplatted areas South of Washington Street to the North boundary of the Great Northern right of way lying between the East and West City Limits boundaries, and Blocks numbered 232, 241, 231, 238, 228, 237, 234, and 235, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Flathead County; and that the City Council of the City of Kalispell, Montana, hereby finds and determines that the contemplated work of improvement is of more than local or ordinary public benefit and that the real property included in such district will be specially bentfitted and affected by such improvement, and the property included within the boundaries of said district is hereby declared to be the property to be assessed for the cost and expense of making said improve- ment. SECTION 3. That the general character of the improvements to be made in the proposed Special Improvement District is the construction of a four -lane highway with curl) and. sidewalk replacements on Idaho Street and North Main Street, according to plans and specifications of the State Highway Commission and Bureau. of Public Roads, Projects We. F 270 (7) and U 257 (14), on file in the office of the State Highway Commission. SECTION 4. That the approximate total cost of the entire program above mentioned of -which such Special Improvement District is a part;­'18 $440,000.00, and the approximate share to be borne by such Special Improvement District is $110,000.00. SECTION 5. That the share to be paid by said Special Improvement District in the approximate amount of $110,000.00 shall be assessed against all the property within the area above described on an area basis in proportion that the area of each lot bears to the total area of the District, except that each square foot of land within the district lying within 25 feet of Idaho Street shall bear double the amount of cost of such improvements per square foot of any other land within the District shall bear. SECTION 6. THkT SAID ASSESSMENT SHALL BE PAID FOR IN TEN equal. annual install- ments hereby extended over a period of ten years. Said assessment shall consti- tute a fund to be known as Special Improvement District Fund No. 290. SECTION 7. That said improvements shall be paid for by Special Improvement District warrants issued against said district in amounts not to exceed $5,000.00, bearing interest not to exceed 4% per annum from date of registration until called for redemption or paid in full. SECTION 8. That on the 7th day of May, 1956, at the Council Room in the City Hall of the City of Kalispell, Montana, at 7:30 P. M,, at a regular meeting, the City Council will hear and pass upon all protests that may be made against the making of such improvements or the creation of such District. Any person or persons who are owners or agents of owners of any lot or parcel of land within said proposed Special Improvement District who shall have, within fifteen days after the publication of this notice, delivered to the City Clark of the City of Kalispell, Montana, a protest in writing against the proposed improvement, or against the creation of said proposed Special Improvement District, or both, shall have the right to appear at said meeting in person or by counsel, and show cause, if any there be, why the improvement proposed to be made should not be made or why such Special Improvement District should riot be created. 4*b SECTION 9. That the City Clerk is hereby authorized and directed to give the proper notice of the passage of this resolution by publication and mailing as required by law, such publication to be made in the Kalispell. News -Farm Journal, a weekly newspaper publishedin the City of Kalispell, Montana. PASSED AND APPROVFD by the City Council of the City of Kalispell, Montana, this 16th day of April, 1956.
