The State of Montana has officially adopted the 2012 International Building, Mechanical, Fire, Energy Fuel Gas and Existing Building Codes, the 2012 Uniform Plumbing Code and the 2014 National Electric Code. The City of Kalispell, in order to maintain its certification with the State Building Codes Bureau, is required to adopt these codes within 90 days of state adoption. Along with the adoption of this code family, the Kalispell Building Department is recommending an increase in the permit fee schedules. The City Council discussed changes and fees within the new codes during the January 26, 2015, work session. The attached resolution of intent calls for a public hearing for the adoption of these codes according to the legal requirements of 7- 1-4127 Montana Code Annotated. If this resolution of intent passes, the public hearing will be held on Tuesday, February 17, 2015, at 7 p.m. during the regular City Council meeting at 201 First Avenue East. ALTERNATIVES: Council can elect to not pass the resolution of intent, or propose modifications as council may desire. If the codes are not adopted by the City of Kalispell within 90 days of the State's adoption in December, the city could lose its certification with the State Building Codes Bureau. RECOMMENDATION: It is recommended that council adopt the resolution calling for a public hearing on February 17, for the proposed adoption of building, fire and electrical codes and related fee changes. WHEREAS, the Montana State Building Codes Bureau has approved the 2012 Edition of the building codes to replace the 2009 Edition and now requires local governments that administer building codes to adopt the 2012 Edition of the building codes; and WHEREAS, the Montana State Building Codes Bureau has approved the 2012 Edition of the International Fire Code (IFC) to replace the 2006 Edition and now requires local governments that administer the IFC to adopt the 2012 Edition of the IFC; and WHEREAS, the City of Kalispell has the personnel, expertise and desire to administer the National Fire Protection Association Standard NFPA 70, National Electrical Code, referred to as the "National Electrical Code (NECY 2014 edition, as amended by the Administrative Rules of Montana, that is currently being administered within the City's territorial jurisdiction by the State of Montana; and WHEREAS, the City of Kalispell Building Department has projected that the revenues to be raised under the existing fee schedule that was adopted in 2008 will be insufficient to fund the projected needs of department to provide the services demanded and has therefore proposed a new fee schedule. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. A public hearing is hereby called and shall be held on Tuesday, February 175 2015 at 7:00 p.m. in the Council chambers on the proposed adoption of Building and Fire Codes and associated fee schedules.
