Resolution 2288 - Federal Aid Project - Idaho StRESOLUTION NO. 2288 FEDERAL AID PROJECT U 25714) WHEREAS, the State Highway Commission is desirous of constructing the Idaho Street, Kalispell section of the Kalispell - West Glacier Road in Flathead County, within the City of Kalispell, beginning at the west City limits, at a point about 100, northwest of the intersection of Idaho Street and Seventh Avenue West, at Survey Station 373+41.3 and extending northeasterly along Idaho Street to a point on Idaho Street about 16, northeast of the intersection of Idaho Street and Eighth Avenue East, at Survey Station 29+70.0, a total distance of 1.068 miles, more or less, and further designated as Federal Air Project No. U 257(14). WHEREAS, the State Highway Commission is desirous of receiving Federal funds for improvement of said highway; and WHEREAS, the Bureau of Public Roads of the U. S. Department of Commerce will not participate in the construction of said street until and unless the City of Kalispell will agree to certain conditions, hereinafter set forth. PHERFFORE, be it resolved by the Council of the City of Kalispell that for and in consideration of the State Highway Commission of Montana and the Bureau of Public Roads of the U. S. ➢epartment of Commerce, constructing said highway and routing traffic on the same within the City of Kalispell, over the above - mentioned street. That it hereby agrees with the State Highway Commission and the Bureau of Public Roads to the following stipulations: 1. That it will not in the future permit encroachments on the right of way of said above -mentioned street. 2. That it will not pass any ordinances or laws fixing a speed limit on the above -mentioned street of under 25 miles per hour. 3. That it will not allow the erection of sips, semaphores, or signals that will give preference to local routes which intersect with said above -mentioned street with the exception of necessary traffic lights. 4. That,it will require stopping of traffic at all intersecting streets and alleys before entering the above -mentioned street with the exception of those intersecting streets where traffic is regulated by traffic lights when traffic gul and lights are in operation. 5. That it will modify its city ordinance to require parallel parking on the above -mentioned street. 6. That it will require that all opening of the pavement be done under direct supervision of the State Highway Commission to -their complete satisfaction and that no opening of the pavement is to be done without prior authorization from the State Highway Commission and upon posting an approved bond in an amount of one thousand dollars ($1,000.00), it being understood that the bond provision does not apply to any work done by the forces of the municipality. 7. That it will service and maintain all traffic lights, storm sewers, water lines, manholes, storm -water inlets, and all other public utilities of a like nature that are within the boundaries of or are related to the above -mentioned street or streets and which may or may not have been constructed with Federal aid and/or State funds.
