Resolution 2265 - Warranty Deed - Armory15A RESOLUTION NO. 2265 It, appearing that the Thirty-fourth Legislative Assembly of the State of Montana enacted legislation permitting the State of Montana to build armories, and that the State of Montana, by its proper department and agency, now desires to build an armory at or near Kalispell, Montana, and has requested the following described parcel of land from The City of Kalispell as,the site for such armory, said parcel being just south of Kalispell and being a part of the city airport property owned by The City of Kalispell; and it appearing that the parcel desired constituting 3.44 acres may be granted to the State of Montana without damage to or interference with the said airport and its use as such, and the lessee of said airport having waived his right to said parcel by an appropriate instrument; and it appearing that such armory will be to the best interests of the City of Kalispell and that the City of Kalispell should cooperate with the National Guard of the State of Montana and any other agencies of the State of Montana involved in the construction and operation of such armory by furnishing, free of charge, the site for such armory, and it appearing that such armory cannot be built unless an appropriate site is furnished free of cost to the State of Montana, and that the parcel of land hereinafter des« cribed is the most favorable location which could be selected for such armory, NOV THEREFORE: IL IT RESOLVED that the Mayor of the City of Kalispell be authorized to execute and deliver an appropriatr,, TTarranty deed to the State of Montana to the parcel of land hereinafter described; that said deed contain an appropriate clause whereby said rarcel will revert to The City of Kalispell should said property not he used for Vie purpose of an armory or its use thereof,be abandoned. The land so authorized to be conveyed is described as follows: Commencing at a point eight hurr1red eighty (880) feet more or less, South 890 501 East of the northwest corner of Section 20, Township 28 North, Range 21 West to the West property line of U. S. Highway No. 93; thence South 330 01' East along property line six hundred (600) feet to the true point of beginning; thence continuing along the West property line of U. S. No. 93 five hundred (500) feet South 330 01' East; thence three hundred (300) feet South 560 591 West; thence five hundred (500) feet North 330 011 West• thence three hundred (300) feet north 560 591 East to the point of beginning, containing 3.44 acres, more or less. CERTIFICATE OF CLERK I, H. J. Hunt, as City Clerk of the City of Kalispell, hereby certify that the foregoing resolution was duly and regularly passed by a two-thirds vote of all the members of the City Council of the City of Kalispell, at the special meeting on April 11, 1955, and that the foregoing is a true and correct copy of such resolution so passed. I further certify that said parcel has not been held in trust by the City for a specific purpose.
