Resolution 2277 - Sale of Real PropertyRESOLUTION NO. 2277 It appearing that when Jack Brown, Sr. constructed his store building on Lot 12 of Block 19 of Kalispell in the year 1952 which encroached six inches to the west on a part of the public ways of the City of Kalispell, which said encroachment occurred through error in the original location of the sidewalk, and it further appearing that Jack Brown, Sr. purchased said six inch strip of ground upon which his building encroached from the City of Kalispell on or about the 8th day of December, 1953; and it further appearing that Jack E. Brown, Jr. has purchased Lots 10 and 11 of said Block 19 of Kalispell and is constructing an enlargement of the said store so built on said Lot 12, and it appearing that said new portion of said building should be even and on a line with the existing part of said building, and that if the existing part of said building jutted out six inches from the new addition to said building that it would create an eye -sore and would be detrimental to the appearance and use of the sidewalk and street in front of said building, and the said J4ck E. Brown, Jr., having submitted his bid in the sum of $250.00 for the hereinafter described parcel of ground and that such is the best, highest and only bid submitted for such parcel and that it will be to the best interests of the City of Kalispell to sell said parcel for such price, NOW THEREFORE - ,BE IT RESOLVED that the Mayor of the City of Kalispell be authorized to execute and deliver a proper grant deed of said parcel to said Jack E. Brown, Jr. upon receipt by the City of Kalispell of said consideration in the sum of $250.00. The land so authorized to be sold is described as follows: Beginning at the Northwest corner of Lot 11 of Bloek 19 of Kalispell, Montana, according to the map or plat thereof on file and of record in the office of the County Clerk and Recorder of Flathead County, Montana; thence southerly along the westerly boundaries of said Lot 11 and Lot 10 to the Southwest corner of said Lot 10 of said Block 19; thence westerly six inches along a line parallel with the south boundary of said Lot 10; thence northerly along a line parallel with the westerly boundaries of said Lots 10 and 11, a distance of 50 feet, more or less, to a line which is the westerly extension of the north line of said Lot 11; thence Easterly along said westerly extension of the north boundary of said Lot 11, a distance of six inches to the Northwest comer of said Lot 11, the place of beginning. CERTIFICATE OF CLERK I, H. J. Hunt, as City Clerk of the City of Kalispell, hereby certify that the foregoing resolution was duly and regularly passed by a two-thirds vote of all the members of the City Council of the City of Kalispell, at the regular meeting on October 3rd, 1955, and that the foregoing is a true and correct copy of such resolution as passed. I further certify that said parcel has not been held in trust by the City for a specific purpose.
