The Kalispell City Planning Board and Zoning Commission, after due and proper notice, o March I O� 2015 , held a public hearing on the application, took public comment and recommende that the application be approved subject to nine (9) conditions. I After reviewing the application, the record, the Kalispell Planning Department report, and after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU- 15- 01 as the Council's findings of fact, and issues and grants to the above -described real property a conditional use permit to allow the operation of a casino in an existing building in the B-2, General Foltusiness zoning district, subjecito the following conditions: A proposed site plan that complies with submitted site plan and modified by these conditions shall be submitted to the Kalispell Site Review Committee for review and approval prior to issuance of a building permit for any structural development. 2. Architectural rendering are required to be submitted to the Kalispell Architectural Revie Committee for review and approval prior to issuance of a building permit. Any words, terms, figures, art work, or features intended or designed to attract attention to the fact that a casino is on site. 4. Neon lighting. 5. Water and sewer main extensions shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction and Montana Public Works Standards. The water and sewer main extension plans shall be reviewed and approved by the Kalispell Public Works Department. 6. The developer shall submit to the Kalispell Public Works Department for review and approval a stormwater report and an engineered drainage plan that meets the requirements of the current City standards for design and construction. 7. A letter from the Kalispell Public Works Department shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for unfinished wort. 411. The developer shall obtain an approach permit from the Montana Department of Transportation for the approach onto West Reserve Drive. 9. All mitigation required as part of the approved traffic impact study shall be completed. All improvements shall be reviewed and approved by either the Public Works Department or Montana Department of Transportation. A letter from the Kalispell Public Works Department or Montana Department of Transportation shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or State of Montana. If infrastructure work has not been accepted, a letter stating that a proper bond has been accepted for the unfinished work by the appropriate agency is required.
