CALL TO ORDER AND
The regular meeting of the Kalispell City Planning Board and
ROLL CALL
Zoning Commission was called to order at 7:00 p.m. Board
members present were: Chad Graham, Charles Pesola, Rory
Young, Matt Regier, Steve Lorch, Doug Kauffman and Karlene
Osorio-Khor. Tom Jentz, PJ Sorensen and Jarod Nygren
represented the Kalispell Planning Department.
APPROVAL OF MINUTES
Lorch moved and Kauffinan seconded a motion to approve the
minutes of the January 13, 2015 meeting .of the Kalispell City
Planning Board and Zoning Commission.
Osorio-Khor suggested an amendment to add the word board in
two places of the following section of the minutes:
Osorio-Khor noted she has recused herself from the board
discussions and board votes regarding the residential on -street
parking permit program. After consulting with the City Attorney
Mr. Harball it is her understanding since she served on both the
neighborhood and school district committees relating to the
parking district she must recuse herself.
There were no objections to the amendment.
VOTE BY ACCLAMATION
The motion, as amended, passed unanimously on a vote by
acclamation.
PUBLIC COMMENT
No one wished to speak.
AGENCY EXEMPTION —
Notice from the Flathead County Board of Commissioners that it
FLATHEAD COUNTY —
intends to construct a two-story government office building at the
SOUTH CAMPUS BUILDING
corner of 1st Avenue West and 1 lth Street West, Kalispell,
Montana, with associated parking on the block along South Main
Street. The construction may by contrary to the Kalispell Zoning
Regulations in one or more regards, including, but not necessarily
limited to, use, setbacks, lot coverage, building height and specific
elements of parking lot design.
STAFF REPORT
P.J. Sorensen, representing the Kalispell Planning Department
reviewed the agency exemption for the board and public in
attendance.
Sorensen noted both public hearings tonight involve agency
exemption requests from Flathead County. Under State law an
agency exemption allows any agency of the state to declare itself
exempt from zoning regulations of a local jurisdiction. In this case
the Flathead County Commissioners made the declaration that they

submitted to the city and then the city provides a public forum for
public comment. The city doesn't approve, condition, or pass the
request on to city council. The comments are received and then
they are available for the county to consider as they move forward
with the design and construction of the project.
Sorensen continued that the first request is for the construction of
the South Campus building, south of the Earl Bennett building on
the corner of 1" Avenue West and 11th Street West. The property
is located in the R-4 residential zone. Sorensen provided some
details of the exemptions requested.
Sorensen noted that three written comments were received all of
which have been distributed to the board and Flathead County.
Shane Jacobs, Architect with CTA Architects Engineers,
representing Flathead County provided an overview of the project.
B.J. Grieve, Director of the Flathead County Planning & Zoning
Office referred to the three comments that were received. In
relation to parking, he noted, the number of parking spaces
provided on the southeast corner of the block complies with the
zoning.
BOARD DISCUSSION
Graham asked where the public would enter the building in relation
to the parking lot and Jacobs provided the location of the entrances,

-the-drop-off-area-for-buses,—and-the ADA-ramp -into -the building.---
Osorio-Khor noted the entrances in relation to the parking lot do
not seem convenient but added the drop-off area will help.

Sorensen noted these exemptions only apply to the zoning so they
still must comply with city building and fire codes and Public
Works standards, etc.
B.J. Grieve, Director of the Flathead County Planning & Zoning
Office introduced Don Mills of the Flathead County Maintenance
Department and added they are representing Flathead County on
this project. He noted their Maintenance Department has been
looking for a shop location for a number of years that would be
able to hold workshops and storage. This location was selected
because of its relatively close proximity to the county campus
without the high visual impact, such as the parking lot for the
proposed South Campus building which was originally proposed
for the location of the maintenance building.
Grieve reviewed the location, the type of building that would be
constructed, access to the property and parking. He noted the
building cannot be accessed from 2nd Avenue West so the alley
between 1st and 2nd Avenue West, which is dedicated to the public,
will be used as the access road to the building. They estimate
approximately 8 vehicle trips per day.
Grieve briefly referenced the exemptions requested and added the
property will be well -maintained.
C-COMMENT--- -- - -Kevin-Buettner, 285-Brown-Road,--Kalispell-asked-whether-the
property would be gated off -hours to limit public access and Mills
indicated that would be their preference.
Sorensen noted one of the comments received also addressed this
project.
Grieve stated the county has received all three copies of the
comments and they will be considered in moving forward on both
projects.
BOARD DISCUSSION I None.
OLD BUSINESS: Osorio-Khor noted there have been discussions regarding the
review of the planning board bylaws and she offered to contact
other entities, within and outside of Montana, to secure copies of
their bylaws for the board's review. Further discussion was held
and there were no objections from the other board members.
Graham stated in relation to public comment when a board member
has public comment or recuses themselves from the board
discussions and votes it would be appropriate for them to step
down and speak from the podium. Osorio-Khor suggested perhaps
that could be added to the bylaws.

Pesola asked if that was Graham's request as President of the
Kalispell City Planning Board and Graham said yes, and it can be
discussed along with the review of the bylaws.
Graham briefly reviewed the council's work session on the
Westside Parking District.
NEW BUSINESS:
Osorio-Khor wanted the public to know that there are three board
vacancies coming up in April. She added although the board
members may ask to remain on the board there may be some public
interest. Jentz noted for the board members whose terms are up
and want to be reappointed, and members of the public who are
interested in serving on the board, letters of interest should be sent
to the Kalispell City Clerk within the next few weeks. Since Rory
Young is the county representative he should send a letter to the
county commissioners.

The following work session was held immediately after the regular

DEVELOPMENT PHASE 4 —
PLANNED UNIT
TKG Spring Prairie Development Four, LLC (TKG) is requesting
DEVELOPMENT
permission to develop the 28 acre site into 14 building pads to be
utilized for general commercial development similar in nature to
— -- - -- - ----- -- -
-phases 1-3-of-Spring-Prair-ie-to-the-immediate north. This -is -a --
multi -application process occurring on State School Trust Lands.
TKG will be developing this project via a lease with the
Department of Natural Resources and Conservation who oversees
State School Trust Lands. The applicants will need the following
approvals from the City of Kalispell:
• Growth Policy map amendment
• Zone change map amendment
• Planned Unit Development Overlay zone
• Subdivision approval
NEXT MEETING
The next regular planning board meeting is scheduled for March
10, 2015 beginning at 7:00 p.m. and located in the Kalispell City
Council Chambers, 201 1" Avenue East, Kalispell.
