Resolution 2169 - SID 286RESOLUTION NO. 23.69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, CREATING SPECIAL TYPROVEIN01T D1STY'ICT NO. 286 IN THE CITY OF KALISPELL, MONTANA, FOR THE PURPOSE OF COY* STRUCTING A SIX INCH SANITARY SEWER EXTENDING ALONG MERIDIAN ROAD FROM THE ALLEY BETWEEN FOURTH AN'D FIFTH STREETS TO THE NORTH PROPERTY LINE OF F{)TJRTH STREB-' WEST. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KALISPELL7 MONTANA: Section 1. That public interest and convenience requires and it is deemed necessary to order and create and the Cit.; Council of the City of Kalispell, Montana intends to order and create a Special Improvement District, with the number, the boundaries and the character of the improvement to be made as are hereinafter set forth. Section 2. That the City Council of the City of Kalispell, Montana, hereby creates and establishes in said city a spetial improvement district for the purpose of making special improve- ments upon and along that portion of MERIDIAN ROAD from the CENTER line of THE ALLEY BE'117111EX FOURTH AND FIFTH STREETS to the NORTH PROPER77Y line of FOURTH STREET including all avenues, streets and alley intersections. Section 3. That the number of said Special Improvement District is hereby designated as "Special Improvement 1)istrict No. 286 of the City of Kalispell, llontana.s® Section 4. That the area embraced by said Special Improve- ment District Is declared to be ns follows: TRACT 5 ISLE OF THE NWJ SEC 18 T 28 N R 21 W TRACT 5 DLC OF THE NVIJ- SEC 18 T 28 N R 21 W BOTH OF WHICH TRACTS ARE WITHIN THE CORPORATE LT1'AITS OF THE CITY OF KALISPELL, MONTANA Section 5. The City Council hereby finds and determines that all real estate situated in said district will. be es pecially benefited and affected by such improvement and the property included within the boundaries of said district i hereby declared to be the property to be assessed for the cost and and expense of making said improvement. Section 6. That the charncter of the improvements to be made in said Special Improvement District is hereby declared to be as follows: Installatdon of approximatel125.0 Lineal Feet of 6 inch diameter sanitary sewer line, one standard 48 inch diameter manhole and two wyes complete together with such incidental work as may be dictated by existing utilities, improvements, and topography all of which improvements are to be made in accordance with the plans and specificat6ons to be prepared by the City En veer of the City of Kalispel ' 1, and to be adopted by the �Iouncil of said City, and which plans and specifications will then be on file in the office of the City Engineer to which reference Is hereby made and be such reference are made z part hereof, to all intents and purposes the same as thought said plans and specifications were fully stt forth and incorporated at length in this resolution. Section 7. That the approximate estimate of the cost and expenses of constructing said improvements is the sum of $580.00 for the dntire district. Section 8. That all the cost and expense incurred in the construct'Lon and making of such impi-.°uvements shall be paid by Special. Improvement District Bonds I with interest coupons attached, such bonds shall be drawn in substantially the form 349 as provided by law in such cases whi.ch said bonds shall be drawn as ainst "Special Improvement District Fund No. 286", hereby ordered and created, and that the entire cost and expense of said Improvement shall be.paid by the said Special Improvement District. Section 9. That said assessment shall be paid for in annual installments and are hereby, extended over a period of five years and berr interest at the rate of not to exceed six per cent (6%) Pear annum from 'the date of their registration, interest payable ann- ually on deferred ay en ; said payraents shall constitute a fund to be known as "Special Tmprovement District Fund No. 2e,611 end it is,hereby ordered that said Speeftal Improvement District Bonds shall be issued ag-Inst such fund, the denom nation and maturlty data!s of such !-,,-,)nds to be fixed by a resolixtion to be hereafter adopted. That the City k;ouncil. of the City of Kalispell, Montana did in sess:lon on the 7th day of "ovember, 1949, at eight O'Clock P.M. finally adopt Resolution of Intention No. 2168. That owners of property embraced by said District have sagned a vaiver signify- ing approval of the proposed district and waiving the advertising and protest period sot by laiv.
