Resolution 2139 - Vacating and Discontinuing StreetRESOLUTION NO. 2139
A RESOLUTION VACATING AND DISCONTINUING SEVENTH STREET
WEST BETWEEN FOURTH AND FIFTH AVENUES wTZT IN KALISPELL.
Whereas, a petition signed by all of the land owners of Lots
on seventh street west between the west boundary of fourth avenue
west and the east boundary of fifth avenue west in Kalispell has
been filed with the City Council and in the4:office of the City Clak
of Kalispell, such petition praying for the closing, vacatingand
discontinuance of the portion of the street above described;
And Whereas a notice of hearing said petition has been duly
published as provided by law for one wqk preceding March 28, 1949
the date fixed for such hearing, which notice stated that the
City Council of Kalispell would hear and act on said petition
at a special meeting of said Gouncil at the Council Chambers in
the City Mall in Kalispell at 7:30 P.M. on March 28, 1949.
Whereas no written protests have been filed against the vacating
of mid street and the City Council having duly considered said
petition and heard and considered verbal protest and argument
for and against the closing of said street and it appearing therefrom
and from Laid petition that such closing and vacating is for
school purposes and the Council deeming that said portion of said
street may be discontinued, cavated and closed without detriment
to the public interest and that it is advisable to close the same
for school purposes.
Be it Therefore Resolved, and this Resolution does hereby
Resolve and Order that that portion of seventh street west in
Kalispell from the west all as shown on the official map or plat
of the Original lownsite of Kalispell be and the same hereby is
discontinued, closed and vacated as a public street way or tho-
roughfare.
Passed and Adopted by the City Council of Kalispell and Approved
by the mayor this 30th day of March, 1949.
