Resolution 2138 - Submit to a Vote - Water Dept Bonds2.80LV�10X M. 2138 305; A RESOLUTION FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITE' OF KALISPELL AT THE GENERAL LONICIPAL ELECTION TO BE HELD APRIL 41 1949 OF THE QUESTION OF ISSUING BONDS OF THE BONDS OF THE CITY OF KALISPELL IN THE AMOUNT OF $64,690.00 FOR THE PURCHASE AND/OR INSTALLATION OF PUMPS, FIRE HYDRANTS RIPE VALUES, FITTINGS AND OTHER MATERIAL FOR THE 2.1UN CIPAL WATER DEPAhTMENT OF KAL13PELL: WHEREAS, a petition has been filed with the City Clerk of the City of Kalispell on the loth day of March signed by more than 20% of the qualified electors eta Kalispell,praying for the submission to the qualfied electors of Kalispelof the question of borrowing money and issuing bonds of the City of Kalispell in the amount of $64,690.00 for the purpose of -:urchasing two new ��umps,, moving steam turbine at the present springs or water supply of the City of Kalispell municipal water system purchase and installation of nine additi nal fire hydrants in the business district of Kalispell, and the purchase of 15000 feet of pipe of various sizes, with necessary valves, fittings, hydrants and other material to be used in the replacement on Wyoming Street between Main Street and 5th Ave. West North in Kalisp1l of the present water main with an eight -inch main and in the enlargement, repair, replacement and improvement elsewhere in Kalispell of the municipally owned water supOjLy and distribution system of Kalispell; the revenues derived and to be derived by the 1,ity of Kalispellfrom the assessment and collection of waterzates, charges rentals and assessments arising out of the operation of such municipal water system, as such ratm charges, rentals and assessments now are or<s they may be fixed mom time to time by contemplated or necessary increases thereof, to be devoted, to the extent':necessary, to the payment and liquidation of principal and interest of such bonds and the indebtedness secured therb7 AND WHEREAS the City Clerk of the City of Kalispell has examined said petition and has found it has a suffieient number of signers ualified to sign the same, and has attached thereto his certificate and presented the same to the City Council of Kalispell, all as provided by Section 5278.7,RCM. 1935; AND WHEREAS said petition has been found to be in proper form and bears the signature of more then 20% of the qualified electors of the City of Kalispell who are taxpayers upon property within said city and whose names a pear upon the last completed assessment roll for state and county taxes, as taxpayers within said city, and said petition is in all other respects sufficient, under -the provisions of Chapter 399 of the Devised Codes of Montana, 1935, as amended; AND WEREAS, a gneral municipal election of the City of Kalispell has been cal ed as provided by law to be held on Monday, April 41 1949, between the hours of A:00 A.M. and 6:00P.M. of said day, and it is deemed and judged b- the Council of the City of Kispell advisable and fey<sible that the question of the issuance of water department bonds as above mentioned be submitted to the qualified electors of the City of Kalispell, as the term qualified electors is used and intended by the provisions of the above mentioned chapter, atsaid general municipi election so to be held on the day and date aforesaid; NOW THEREFORE BE IT RESOLVED, by the City "ouncil of the City of Kalispell, that there be submitted to the qualfied electors of the City of Kalispell, who are taxpayers upon property within said city and whose names appear on the last completed assessment roll for state and county taxes, as taxpayers within said city, at the general city election to be held in Kalispell on April, 41 1949 between the hours of 8:00 A.M. and 6:00 P.M. of said day the question of borrowing money and issuing bonds of said city in the amount of $64,690.00 for the purpose of purchasing and/or installing two additional pumps and moving a steam turbine at the (Ounicipal water supply, purchasing and installing nine additional fire hydrants in the business section of Kalispell, the purchase of 15000 feet pf pipe of various sizes with valves, hydrants, fittings and other necessary material for replacement of the water main on West Wyoming Street and replacement, repair or enlargement of the water distribution system elsewhere in Kalispell. all as hereinabnvp sAf fnrflh• RE IT FURTHER RESOLVED that the revenues derived and to be derived by the City of Kalispell from the assessment and collection of water rats charges, assessments and rentals arising out of the operation of the Kalispell Municipal Water Department and System,as the same now are or may be hereafter fixed or set, shall to the extends necessary, be devoted to the payment and liqu'dation of principal and interest of such bonds and the indebtedness thereby secured; and that said City of Kalispell, by and through its Council, may if necessary to pay and liquidate the principal and interest on such bonds and indebtedness, increase such water rates, rentals, assessments and charges from time to time, subject to the approval of the Public Service Commission of Montana; BE IT FURTHER RESOLVED, that such bonds shall be either amortiaation or serial bonds, shall be paid through a period of five years, and shall be redeemable at the option of the City Council of Kalispell at any time before maturity, if so recited in said bonds, and shall bear inter st at not to exceed 6% per annum; BE IT FURTHER RESOLVED That the City Clerk of the City of Kalispell is hereby authorized and directed to dve the necessary notices of such election and of the submission of such uestion to the qualified electors of the City d>'f'' Kalispell and to prepare the necessary ballots therefor and to do all other acts and things necessary for the accomplish- ment of the purposes of this resolution.
