07. Master Plan Amendment to Gardner Auction and Zone ChangeAgenda -December 9, 1996 AGENDA ITEM 7 - PLANNING BOARD RECOMMENDATION TO INITIATE MASTER PLAN AMENDMENT TO GARDNER AUCTION AND ZONE CHANGE BACKGROUND/CONSIDERATION: As a follow-up request/action from FRDO in reference to the Gardner Auction property, I have enclosed a letter from the President of the Planning Board and Zoning Commission that suggests the Gardner Auction property may be inappropriately zoned as R4-1- A change for this property to I-1 Light Industrial is recommended by the Commission. RECOMMENDATION: Upon review of the current zoning surrounding usage/zoning and potential use of the facility and property, I concur with the Zoning Commission that this property should be re- zoned to accurately reflect current and future usage. I recommend a Master Plan Amendment and Zone Change to I-1 Light Industrial District be approved. ACTION REQUIRED: Direction at the workshop for staff to compile the changes or suggestions is necessary. Drawer 1997 Kalispell, MT 59903 Re: Gardner Auction Service Master Plan Amendment and Zone Change Dear Clarence: Phone: (406) 758-5980 Fax: (406) 758-5781 At their regular meeting of November 14, 1996, the Kalispell City -County Planning Board considered a request by Gardner Auction Service for a zoning text amendment to allow a change from one nonconforming use to another nonconforming use provided that the new use had equal or less impact. As you are aware, the planning board has recommended to the Kalispell City Council that this request be denied. While considering the request by the Gardners for the proposed text amendment, the board questioned why the zoning on their property was RA-1 rather than light industrial which would be consistent with the use. The staff responded that the master plan has always designated that property as high density residential and the zoning is consistent with that designation. The board was concerned that the Gardners may have been led in an inappropriate direction by the staff in applying for a text amendment, and stated that they would rather support a zone change to address the Gardners problems with changing the use of the auction barn. However, they felt that the Gardners should not have to pay additional fees to initiate a master plan amendment and zone change. It was the feeling of the planning board that the property had been inappropriately designated as high density residential and should have been zoned to reflect the use. The board would therefore recommend to the City Council that they initiate a master plan amendment and zone change for this property from the current RA-1, a residential apartment district, to I-1, a light industrial district.
