ORDINANCE 1273-DUTY TO KEEP SIDEWALKS CLEAN OF SNOW, ICE, ETC. 2ND READING C. ORDINANCE r., FROM PREMISESONTO PUBLIC PROftAft2NDrN BACKGROUND/CONSIDERATION: All of these ORDINANCES are the continuation of several discussions and will complete the final readings/approvals needed for the new snow policy. AN ORDINANCE AMENDING CHAPTER 17, MOTOR VEHICLES AND TRAFFIC, KALISPELL MUNICIPAL CODE BY AMENDING ORDINANCE NO'S 627, f 2; 766, 6 1; AUTHORIZING THE CITY ATTORNEY TO RECODIFY CHAPTER 17, KALISPELL MUNICIPAL CODE IN ACCORDANCE WITH THIS ORDINANCE; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That Ordinance No's 627, § 2; 766, § 1;(§ 17- 76, Kalispell Municipal Code) is hereby amended to read as follows: Upon proclamation of the City Manager (or his designee) of the snow event season, no person shall park, abandon or leave unattended any vehicle on any public street except as described herein. On even numbered calendar days parking shall be permitted on public streets on the side of the street with even numbered addresses. On odd numbered calendar days parking shall be permitted on the side of the street with odd numbered addresses. For purposes of this Ordinance, vehicles shall be considered legally parked, if properly parked at five o'clock (5:00) P.M. on the previous day. Parking shall not be permitted in City owned off-street parking areas between the hours of two o'clock (2:00) A.M. to six o'clock (6:00) A.M. In the Central Business District, the on -street parking prohibition shall be between two o'clock (2:00) A.M. to six o'clock (6:00) A.M. The snow event season parking ban shall continue until ended by the proclamation of the City Manager (or his designee). SECTION II: Except as otherwise provided herein, any person violating any of the provisions of this article shall, upon conviction thereof, be punished as provided in Section 1-9. SECTION IiI: That the City Attorney is hereby authorized and directed to recodify Chapter 17, Motor Vehicles and Traffic, Kalispell Municipal Code in accordance with this Ordinance. j:\wp\ord\snow17-76 SECTION IV. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That R.O. 1947, § 975, (§ 24-17, Kalispell Municipal Code) is hereby amended to read as follows: Upon announcement of the City Manager (or his designee) of a snow event, it shall be the duty of the occupant of any premises within the City limits, except within the City's Central Business District, or in case the same are unoccupied, then of the owner or his agent, to keep the sidewalks in front of and adjoining his premises clean and safe for pedestrians. Such occupant, owner or agent shall, within 72 hours of said announcement, remove snow, ice, slush, mud or other impediment to safe and convenient foot travel, and prevent the continuance and accumulation of the same. Notice of a snow event announcement shall be made by Public Service Announcements on local radio, televison and in the newspaper. Within the City's Central Business District the owners, agents, or occupants shall remove any accumulation of snow, ice, slush, mud or other impediments to foot travel by twelve o'clock (12:00) Noon on the day that any amount accumulates. For purposes of this Ordinance Central Business District shall include all sidewalks on both sides of any street or avenue within the area bounded by 111t Avenue East (on the East), lot Avenue Weston the West), Idaho Street (on the North) and 6tn Street (on the South). ,SECTION II: Except as otherwise provided herein, any person violating any of the provisions of this article shall, upon conviction thereof, be punished as provided in Section 1-9. j:\wp\ord\snow24-17 SECTION III: That the City Attorney is hereby authorized and directed to recodify Chapter 24, Streets and Sidewalks, Kalispell Municipal Code in accordance with this Ordinance. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That Ordinance No. 680, § 1(§ 24-18, Kalispell Municipal Code) is hereby amended to read as follows: It shall be unlawful to push snow from private property onto city sidewalks, streets and boulevards. SECTION II: Except as otherwise provided herein, any person violating any of the provisions of this article shall, upon conviction thereof, be punished as provided in Section 1-9. SECTION III: That the City Attorney is hereby authorized and. directed to recodify Chapter-_24 Streets acid Sidewalks,--. Kalispell Municipal Code in accordance with this: Ordinance. SECTION IV.
