04C. Emergency Ordinance 1271 - Pushing Snow from Private PremisesORDINANCE NO. 1271 AN ORDINANCE AMENDING CHAPTER 24, STREETS AND SIDEWALKS, KALISPELL MUNICIPAL CODE BY AMENDING ORDINANCE NO. 680, 8 1; AUTHORIZING THE CITY ATTORNEY TO RECODIFY CHAPTER 24, KALISPELL MUNICIPAL CODE IN ACCORDANCE WITH THIS ORDINANCE; DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That Ordinance No. 680, § 1(§ 24-18, Kalispell Municipal Code) is hereby amended to read as follows: It shall be unlawful to push snow from private property onto city sidewalks, streets and boulevards. SECTION IT: Except as otherwise provided herein, any person violating any of the provisions of this article shall, upon conviction thereof, be punished as provided in Section 1-9. f SECTION III: That the City Attorney is hereby authorized and directed to recodify Chapter 24, Streets and Sidewalks, Kalispell Municipal Code in accordance with this Ordinance. SECTION IV. An emergency is hereby declared to exist in the City of Kalispell because accumulation of snow and ice within the City is deleterious to the health, safety and welfare of the community. Under the provisions of Sections 7-5-104 and 7-5-4206, MCA, this Ordinance shall take effect immediately and expire from and after 90 days of its passage by the City Council.
