AGENDA ITEM 4 - SNOW REMOVAL ORDINANCE AMENDMENTS
BACKGROUND/CONSIDERATION: Due to the changes in the snow policy, all six of the
following ordinance changes are required to assure the coordination and enforcement is consistent
with the policy.
A. ORDINANCE 1269-Amend Chapter 17, Section 76-Parking
Requirements During Snow Season Event (emergency)
B. ORDINANCE 1270-Amend Chapter 24, Section 17-Duty to Keep
Sidewalks Clean of Snow, Ice, Etc. (emergency)
C. ORDINANCE 1271-Amend Chapter 24, Section 18-Pushing Snow From
Private Premises Onto Streets and Sidewalks Policy (emergency)
D. ORDINANCE 1272-Amend Chapter 17, Section 76-Parking
Requirements During Snow Season Event (regular)
E. ORDINANCE 1273-Amend Chapter 24, Section 17-Duty to Keep
Sidewalks Clean of Snow, Ice, Etc. (regular)
F. ORDINANCE 1274-Amend Chapter 24, Section 18-Pushing Snow From
Private Premises Onto Streets and Sidewalks Policy (regular)
RECOMMENDATION: Since we have had discussions about these changes at prior meetings and
the changes have been anticipated in all of the presentations of the snow policy changes, I highly
recommend that the changes for the ordinances be approved.

ACTION REQUIRED: First Readings would be the normal process for approval of these
ordinances. However, due to the timing of the policies and the fact that snow could hit us at any
time, I would suggest that we may want to pass ORDINANCES 1269,1270, and 1271 under the
emergency provisions for ordinances, and 1272, 1273, and 1274 can be passed under the regular
process.
ORDINANCE NO. 1269
AN ORDINANCE AMENDING CHAPTER 17, MOTOR VEHICLES AND TRAFFIC,
KALISPELL MUNICIPAL CODE BY AMENDING ORDINANCE NO'S 627, $ 2; 766,
§ 1; AUTHORIZING THE CITY ATTORNEY TO RECODIFY CHAPTER 7, KALISPELL
MUNICIPAL CODE IN ACCORDANCE WITH THIS ORDINANCE; DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION I. That Ordinance No's 627, § 2; 766, § 1;(§ 17-
76, Kalispell Municipal Code) is hereby amended to read as
follows:
Upon proclamation of the City Manager of the snow event
season, no person shall park, abandon or leave unattended any
vehicle on any public street except as described herein. On
even numbered calendar days parking shall be permitted on
public streets on the side of the street with even numbered
address. On odd numbered calendar days parking shall be
permitted on the side of the street with odd numbered
addresses. Parking shall not be permitted in City owned off-
street parking areas between the hours of= o o'clock (2:00)
A.M. to six o'clock A.M. in the Central b siness District,
the on -street parking prohibition shall be tween two o'clock
(2:00) A.M. to six o'clock A.M. The snow event season parking
ban shall continue until ended by the proclamation of the City
Manager.
SECTION II: Except as otherwise provided herein, any person
violating any of the provisions of this article shall, upon
conviction thereof, be punished as provided in Section 1-9.
SECTION III: That the City Attorney is hereby authorized and
directed to recodify Chapter 17, Motor.Vehicles and Traffic,
Kalispell Municipal Code in accordance with this Ordinance.
.SECTION IV. An emergency is hereby declared to exist in the
City of Kalispell because accumulation of snow and ice within
the City is deleterious to the health, safety and welfare of

the community. Under the provisions of Section 7-5-104 and 7-
5-4206, MCP,, this Ordinance shall take effect immediately and
expire from and after 90 days of its passage by the City
Council.
