AGENDA ITEM 8 - HAMMERQUIST REQUEST
BACKGROUND/CONSIDERATION: Enclosed are requests from Mr. Curt Hammerquist
concerning extension of Sewer Service Connections. This property lies along the Stillwater River
west of the Burlington Northern Railroad tracks and east of the gravel pit of McElroy and Wilken.
RECOMMENDATION: The Staff and I strongly recommend anainst any consideration of this
sewer connection request. This property is a considerable distance from our municipal boundaries,
not contiguous, and, even more important, annexation of this area will not happen unless or until the
entire Evergreen annexation question is resolved. We must say no to annexation in a piece -meal
fashion and place ourselves into a stronger position to leverage annexation consideration by
Evergreen residents. The typical waiver and/or agreement to annex at a later date, in my opinion,
substantially weakens our position in achieving an annexation into one community.
ACTION REQUIRED: DIRECTION to Staff is needed.

Re: Hammerquist's Second Request for Sanitary Sewer Service
Evergreen Property Beyond the RSID Boundaries
Attached please find a letter from Curt Hammerquist with a second request for
sanitary sewer service to his property beyond the west boundary of the Evergreen
Water and Sewer District. A map of the property and our previous memo of June
17th are also included.
- Mr. Hammerquist originally requested permission to connect 11 lots to the sanitary
sewer. The request was denied in mid July because it is not practical to annex the
property at this time. He has since received a purchase offer from a mobile home
park developer, contingent upon access to City sewer. He has repeated his request
for service and again been denied by staff. As a final appeal, he respectfully
requests a City Council decision on the matter.
We believe the Council's policy to require annexation prior to receiving service is
in the City's best interest and should be followed in this case.

We respectively request sewer hookup for 13 acres at 444 Flathead Drive.
We would like to put in a mobile home park with 20 to 22 hookups. The
parcel is on a dead end road with the river on the West and North sides and
the railroad on the East. We would bore under the railroad to hook up on
Nicholson Drive.
The plot plan that we are enclosing is for 11 one acre lots with septic
service.

Evergreen Property Beyond RSID Boundaries
Under the terms of our Interlocal Agreement with the Evergreen Water and Sewer
District (EWSD), the City of Kalispell must approve any connection to the
Evergreen sewer system from properties which lie beyond the district's boundaries.
Attached you will find a copy of information submitted by Carl Hammerquist as his
request for authorization to connect to the Evergreen sewer system. In accordance
with our requirements, he has provided a map showing the property in question, a
petition for annexation, a waiver of right to protest annexation and a statement of
his intent to rezone the property and allow for up to 22 dwelling units. Mr.
Hammerquist began his subdivision planning with the concept of on -site sewage
disposal, but now wants to extend the sanitary sewer to enable a higher density
development. The map shows his property to be on the west edge of the district,
between the Burlington Northern Railroad and the City limits, but still rather
remote from the City.
In light of our unwritten policy to require annexation prior to development, we
recommend this request be denied. We informed Mr. Hammerquist of our policy
and identified this process as his means of appeal beyond the staff level. Please
notify us of your decision or intentions for further action and we will inform Mr.
Hammerquist accordingly.
