AGENDA ITEM 7 - JUDY KERR REQUEST FOR SEWER
BACKGROUND/CONSIDERATION: I have enclosed correspondence from Mrs.
Judy Kerr of 1672 Stag Lane requesting permission to connect to the
City's sewer system. I am not certain about the comment attributed
to Mr. Wilson about the Green Acres Homeowner's Association and
their opposition to annexation. However, the staff position has
been no approvals of service outside the City until an agreement
for annexation is obtained. It appears that the Evergreen
annexation is a long term situation and will not happen in the near
f., future. (The eight lots that had problems last year were allowed
to connect to the sewer line at their own expense and payment of
the sewer connection fee.)
We certainly understand and appreciate the problem and frustration
with the septic systems within Evergreen. However, I do not
believe it is our responsibility to correct the problems created by
the homeowner, developer, or their public agencies.
Specifically, in this case, Lot 85, has a sewer main right behind
their house that is approximately 3 feet deep. To connect to this
line the homeowner will need to install a "lift pump" to enable
them to use the sewer. There is no need for City improvements or

expense.
RECOMMENDATION: To continue to comply with the philosophy of not
providing services unless the property annexes, I recommend
disapproval of this request.
ACTION REQUIRED: A MOTION to approve/disapprove the request will
give staff direction.

Enclosed please find a copy of a letter I sent to the Kalispell City Council on today's
date. I would also like to enlist your help in solving this problem in a timely fashion.
If there is anything else I can do to help speed up this process please let me know.
I am willing to work with the City Council Members to come to a quick solution that will
be in agreement with all parties concerned. Please feel free to contact me for any further

Dear Council Members,
I recently contacted Mr. John Wilson of the City Water & Sewer Department regarding
the possibility of us connecting to the city sewer system. We have had some major
problems the last two years with excess ground water flooding our drain field causing our
septic system to back up into the basement.
Mr. Wilson informed me that we were being denied access to the city sewer system
because the Greenacres Homeowners Association is not supporting annexation of this
area. I am afraid that I cannot wait for all the legal battles to take place, I need assistance
right now.
My husband was transferred to the State of Minnesota in June in his line of employment
and has been working in a permanent position there since. We have put our house up for
sale and plan to move during the last week in August. My husband had contacted Mr.
Wilson last year regarding this same problem and at that time there did not seem to be
any problem in connecting with the city's system as long as we paid the connection fees.
We cannot honestly sell our house with the existing septic system as it is knowing the
problems it can cause the next homeowner.
I am asking that you would look at this problem as an individual case rather than as a
group problem with the Greenacres Homeowners Association. Time is of the essence for
our family and we would appreciate an immediate response so this situation can be taken
care of as soon as possible.
