05. Equity Supply Request to Abandon 2nd Ave WNAgenda -July 21, 1997 AGENDA ITEM 5 - EQUITY SUPPLY REQUEST TO CLOSE 2ND AVENUE WEST NORTH BACKGROUNDICONSIDERATION: I have enclosed a letter of request for the closing of 2nd Avenue W. N. to assist in the three -party redevelopment agreement. As pointed out in the previous agenda item, Barbieri's will purchase the land from Equity as a package (including street right-of-way). We are deducting $89,100 for the value of the street from the original amount we offered Equity. RECOMMENDATION: I recommend approval of the closing of the street (if the development agreement is acceptable). ACTION REQUIRED: A MOTION to authorize the notice of vacation to be published. Box 1997 Kalispell, Montana 59903 RE: Street Abandonment Request Dear Clarence, JUL 10 1997 Equity Supply Company, a Montana corporation with principal address being 150 1st Ave. W.N., Kalispell, Montana hereby requests that the City of Kalispell begin formal legal action required to close, abandon and vacate the street and right of way plated as 2nd Ave. W.N. between the BN railroad tracks on the South and Montana Street on the North. Any public utility easements may be reserved by the City of Kalispell. Equity Supply Company is the sole owner of all property on both the East and West sides of the street legally described as all of Block 27 and the East half of Block 28, City of Kalispell. The reason for this abandonment request is to accomodate redevelopment of the area. An official corporate resolution will be prepared and placed on the agenda for our next Board of Directors meeting scheduled for July 24, 1997.
